Irwan Syah Rizal pleaded guilty to two charges of driving a motorcycle recklessly causing injury to the victim.KAJANG: An unemployed man was sentenced to six months in prison by the Magistrate's Court for riding a motorcycle recklessly and causing injury to an elderly person, last week.
Magistrate Nik Siti Norazlini Nik Mohamed Faiz handed down the sentence to Irwan Syah Rizal, 35, after the accused pleaded guilty to both charges and ordered the sentences for the two offenses to run separately from the date of arrest on 3 September last.
For the offense of riding a motorcycle while distracted, the court sentenced him to two months in prison while for the offense of wounding, he was sentenced to four months.
Irwan Syah was charged with intentionally causing injury to Low Khoon Hwa, 71, at Jalan Cheras Perdana, Hulu Langat, near here at 11.25am, 1 September last according to Section 323 of the Penal Code which carries a prison sentence of up to one year or a maximum fine of RM2,000 or both.
The accused was also charged with driving a motorcycle recklessly to endanger the victim's life at the same place, time and date in accordance with Section 279 of the Penal Code which provides for a maximum prison sentence of six months or a fine of up to RM2,000 or both.
Yayasan Bantuan Gaman Kebangsaan (YBGK) lawyer Nurshuhada Imraanuar, who represented the accused, requested that his client be sentenced to prison concurrently for both offences.
However, Deputy Public Prosecutor Norfarhanim Abdul Halim requested the court to impose a heavy sentence as a lesson for the accused and the general public.
"We request that the court consider the actions of the accused who rode a motorcycle against the flow of life threatening other road users.
"Besides that, the reckless actions of the accused who have caused injury to the victim must be considered. We request that a punishment in the form of public interest be imposed on the accused," he said.
