MCMC, police call up TikTok's management over provocative videos

30/11/2022

KUALA LUMPUR, Nov 30 (Bernama) -- The Malaysian Communications and Multimedia Commission (MCMC) and the police have called up TikTok’s management to provide an explanation for the three video clips that warned of the recurrence of the May 13, 1969 riots.

MCMC in a statement today said that the circulation of provocative content with the intention of causing disharmony, hatred and prejudice is an offence under Act 574 of the Penal Code that will result in a fine or imprisonment or both if convicted.

"The spreading of such video content is an irresponsible act which is feared to cause disharmony, division, feelings of hatred or prejudice in matters related to religion and race," read the statement.

It said that MCMC would continue to monitor the circulation of the video clips, adding that efforts to curb the spread of such videos would be increased in collaboration with the police.

A news portal today reported that several social media users had pointed out that the videos had the 'paid partnership' tag.

Conference of Rulers proposes PM cease appointing JAC members

The Yang Dipertuan Besar of Negeri Sembilan, Tuanku Muhriz Tuanku Munawir (right) chaired the 260th Conference of Rulers at Istana Negara, today.

30/11/2022 08:18 PM
KUALA LUMPUR, Nov 30 (Bernama) -- The Conference of Rulers is proposing that five of the nine members of the Judicial Appointments Committee (JAC) no longerbe appointed by the prime minister so that its composition is more balanced and does not carry the interest of any party.

The Yang Dipertuan Besar of Negeri Sembilan, Tuanku Muhriz Tuanku Munawir, who chaired the 260th Conference of Rulers meeting today, said in terms of the judicial system, the Conference of Rulers is responsible for the appointment of judges in Malaysia, and at present, this process is seen as having weaknesses thatcan be improved, JAC’s membership included.

His Highness said JAC plays a key role in proposing judicial nominations, and therefore its membership was critical in ensuring that the committee continued to be looked up to and is capable of nominating judges of calibre and integrity.

“Instead, it (power to appoint JAC members) should be given to several other institutions such as the Malaysian Bar, the Sabah Law Society, Advocates Association of Sarawak and Parliament's Select Committee.

“Currently, JAC has nine members, four of whom are senior judges while five more are individuals appointed by the Prime Minister,” Tuanku Muhriz said in his message in conjunction with the two-day 260th Conference of Rulers meeting that began yesterday at Istana Negara.

The Yang di-Pertuan Agong, Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah, Malay State Rulers as well as the Yang Dipertua Negeri of Penang, Melaka, Sabah and Sarawak attended the meeting.

In addition, the Conference of Rulers also proposed for JAC’s structure to be re-evaluated through discussions between the government, existing JAC members, legal bodies as well as institutions or other relevant stakeholders.

Tuanku Muhriz expressed confidence that with improvements made, JAC will be able to carry out its responsibilities more effectively and ensure that the selection and appointment of judges in Malaysia are from among individuals of noble character and who are transparent and just.

“As cited in two of the principles of Rukun Negara, namely Supremacy of the Constitution and the Rule of Law, these principles are extremely important to ensure enforcement agencies and the Judiciary are free from external influence in executing their responsibilities,” His Highness said.

KUALA LUMPUR: The Malaysian Meteorological Department (MetMalaysia) has issued a warning of continuous rain in eight states from tomorrow until Sunday (Dec 4).

MetMalaysia said in a statement today that continuous rain is expected from tomorrow until Saturday (Dec 3) in four states, namely Perak (Hulu Perak); Kelantan (Tumpat, Pasir Mas, Kota Bharu, Jeli, Tanah Merah, Bachok, Machang, Pasir Puteh and Kuala Krai); Pahang (Jerantut, Kuantan and Pekan); and the whole of Terengganu.

Similar weather condition is forecast to begin tomorrow in Sabah, involving areas in Sandakan (Telupid, Kinabatangan and Beluran) and Kudat while Perlis, Kedah and Penang are expected to experience two days of continuous rain from Saturday (Dec 3).

Meanwhile, MetMalaysia said in a separate statement that continuous heavy rain is expected in the east of Sabah, the east coast and the north of the peninsula from tomorrow until Monday (Dec 5) due to strong easterly winds from the western Pacific Ocean.

MetMalaysia said that, at the same time, the low-pressure system that is expected to form in the South China Sea on Friday (Dec 2) could move westward across the Malaysia-Thailand border heading towards the Andaman Sea on Saturday (Dec 3) and Sunday (Dec 4), and could increase the intensity of rain.

"Strong waves and winds are expected to hit coastal areas as well as the waters of Kelantan and Terengganu. This situation is dangerous to any beach or sea activity," the statement added.

MetMalaysia advised the public in the affected areas to be more aware and prepared for any eventuality.

KUALA LUMPUR: The Attorney-General's Chambers (AGC) today confirmed that it is not appealing against the High Court ruling to return to Datuk Seri Najib Tun Razak and his wife Datin Seri Rosmah Mansor the RM80 million worth of jewellery, luxury watches and designer handbags that were confiscated from Pavilion Residences here on May 17, 2018.

Attorney-General Tan Sri Idrus Harun, when contacted by Bernama, said AGC was not appealing against the decision of Judge Datuk Muhammad Jamil Hussin on Nov 14, 2022.

"Yes, AGC is not appealing against the decision of the learned judge as we agree with His Lordship's decision," said Idrus via a WhatsApp message.

On Nov 14, judge Muhammad Jamil ruled that the prosecution failed to prove that all the items confiscated by police at Pavilion Residences, which was owned Obyu Holdings Sdn Bhd, were obtained through the misappropriation of 1Malaysia Development Berhad (1MDB) funds.

The judge also rejected the prosecution's request to stay the execution of the decision pending an appeal to be filed and decided by the Court of Appeal.

The former prime minister and his wife are third parties in the prosecution's application as the plaintiff to forfeit the rights to the items. Any third party who claims to have an interest in the confiscated goods can appear in court to present reasons why they should not be forfeited to the government.

In 2019, the prosecution had filed a forfeiture application against Obyu Holdings to forfeit the 2,435 pieces of jewellery, seven luxury watches and 29 designer handbags and cash amounting to RM114,164,393.44 allegedly belonging to UMNO and Najib. However, the government failed to forfeit the money.

The items, alleged to be proceeds of illegal activities linked to the 1MDB fund scandal, were confiscated under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act (AMLATFPUAA) 2001.

The jewellery and handbags allegedly belonged to Rosmah while the watches to Najib.

PUTRAJAYA: Actor-director Farid Kamil Zahari was fined RM5,000 for administering drugs to himself four years ago.

This followed the Court of Appeal's decision today in allowing his appeal to set aside his nine-month jail sentence imposed by the Petaling Jaya Magistrate's Court in 2019 and substituted the sentence for a fine instead.

The three-panel bench led by Datuk Seri Kamaludin Md Said, however, upheld a two-year supervision by the National Anti-Drug Agency on the actor and ordered him to serve six months' jail if he failed to pay the fine.

Farid Kamil paid the fine.

Kamaludin, who sat with Judges Datuk Wira Ahmad Nasfy Yasin and Datuk See Mee Chun, in a unanimous decision, said the Magistrate's Court was inconsistent in its consideration when passing down the jail sentence against Farid Kamil.

The judge said there was no concrete explanation that can state that the punishment is commensurate with the offence committed at the time and that were aggravating aspects, such as past offences.

"In this case, we found the facts quite straightforward and did not lead to a too serious or heavy offence," he said.

On May 15, 2019, the Magistrate's Court sentenced the actor to nine months jail after finding him guilty of using the THC drug or "11-nor-delta-9-tetrahydrocannabinol-9-carboxylic acid" at the narcotics office of the Petaling Jaya Police headquarters at 4.30 pm on Jan 11, 2018.

In November 2019, the Shah Alam High Court upheld the sentence which prompted the actor to file an appeal to the Appeals Court.

His wife, actress Diana Danielle, and his brother, Fadzil, were present at the court today.

When met outside the court, Farid Kamil expressed his gratitude for today's decision, which he described as the best for him.

"I'm so happy now that the case is finally settled and I can focus on my next film, Anwar, which is now at the final stage of filming and scheduled to hit the cinemas in February next year," he said.

Farid Kamil was represented by lawyers Datuk Hisyam Teh Poh Teik, Kee Wei Lon and Low Wei Loke, while deputy public prosecutor Eyu Ghim Siang appeared for the prosecution.

Christians now a minority in England and Wales

Fewer than half of people in England and Wales identify as Christian, according to census data released on Tuesday, underlining a landmark shift towards secularism in multicultural Britain.

The findings from the 10-yearly census, carried out in 2021, came just over a month after Rishi Sunak became Britain's first Hindu prime minister.

They showed rapid growth among the Muslim population. However, "no religion" was the second most common response after "Christian", the Office for National Statistics (ONS) said.

Archbishop of York Stephen Cottrell said it was no "great surprise" that the Christian proportion was declining over time.

But he said that, facing a cost-of-living crisis and war in Europe, people still needed spiritual sustenance.

"We will be there for them, in many cases, providing food and warmth. And at Christmas, millions of people will still come to our services," said the Anglican Church's second-ranking cleric.

But the group Humanists UK, which campaigns for the rights of non-religious people, said the government should take on board policy implications.

Those included government backing for religious schools and for the established Church of England, its chief executive Andrew Copson said.

"Iran is the only other state in the world that has clerics voting in its legislature. And no other country in the world requires compulsory Christian worship in (non-religious) schools as standard," he said.

"This census result should be a wake-up call which prompts fresh reconsiderations of the role of religion in society."

- 'That's just Britain' -

Some 27.5 million people, or 46.2 percent in England and Wales, described themselves as Christian, down 13.1 percentage points from 2011.

"No religion" rose by 12 points to 37.2 percent or 22.2 million, while Muslims stood at 3.9 million or 6.5 percent of the population, up from 4.9 percent before.

The next most common responses were Hindu (1.0 million) and Sikh (524,000), while Buddhists overtook Jewish people (273,000 and 271,000 respectively).

"Obviously the UK is a diverse country and that is to be welcomed, and that includes diversity of religion as well," Sunak's spokesman told reporters in response to the census.

Sunak won the race to replace Liz Truss as prime minister and leader of the Conservative Party on October 24, the same day that Hindus marked Diwali, the festival of lights.

The next day, the new premier's first formal event in 10 Downing Street was a Diwali reception.

On Tuesday, Sunak was hosting a Downing Street reception marking the Advent build-up to Christmas with "guests invited from across the Christian community", the spokesman said.

The former finance minister's grandparents hailed from Punjab in northern India and emigrated to Britain from eastern Africa in the 1960s.

"As chancellor I was able to light my Diwali diyas (lamps) on the steps of Downing Street," Sunak told The Times newspaper this month.

"It said something wonderful about our country that that was possible, but also that it wasn't a big deal.

"It was in a sense 'Gosh, this is great' but also that's just Britain," he added, reflecting on his ascent to the political peak.

- African evangelicals -

The ONS has been releasing key sections from last year's census piecemeal. The latest dealt with religion and ethnic identity.

Data for Scotland and Northern Ireland are released separately.

It found the number of people in England and Wales identifying their ethnic group as white had fallen by around 500,000 since 2011, from 86.0 percent to 81.7 percent.

The second most common ethnic group was "Asian" broadly, at 9.3 percent, up from 7.5 percent a decade ago.

Within that group, most respondents identified their family heritage as Indian, followed by Pakistani, "other Asian", Bangladeshi and Chinese.

The next largest ethnic group was the fast-growing African population, followed by Caribbean.

African evangelical churches have proliferated in London and elsewhere, providing some succour to the Christian share.

BEIJING: Opponents of China's anti-COVID measures are resorting to dating apps and social media platforms blocked on the mainland to evade censors, spread the word about their defiance and strategy, in a high-tech game of cat and mouse with police.

Videos, images and accounts of the opposition to China's tough COVID-19 curbs have poured onto China's tightly censored cyberspace since weekend protests, with activists saving them to platforms abroad before the censors delete them, social media users say.

Protesters came out in several Chinese cities for three days from Friday in a show of civil disobedience unprecedented since President Xi Jinping assumed power a decade ago.

Frustration has been building with the stringent zero-COVID policy nearly three years after the coronavirus emerged in the central city of Wuhan but the spark for the wave of protests was a deadly apartment building fire in the western city of Urumqi.

Authorities denied accusations posted on social media that a lockdown had prevented people escaping the blaze but that did not prevent protests on Urumqi streets, videos of which were posted on the Weibo and Douyin social media apps.

Censors tried to scrub them quickly but they were downloaded and reposted not only across Chinese social media but also to Twitter and Instagram, which are blocked in China.

Residents of other cities and students on campuses across China then organised their own gatherings, which they in turn filmed and posted online.

"People are watching and playing off each other,” said Kevin Slaten, head of research for China Dissent Monitor, a database run by U.S.-based non-profit Freedom House.

State media has not mentioned the protests and the government has said little.

The foreign ministry said on Tuesday, when asked about the protests, that China was a country with rule of law and all rights and freedoms of its citizens are protected but they must be exercised within the framework of the law.

A senior health official said public complaints about COVID controls stemmed from overzealous implementation and not from the measures themselves.

CRYPTIC COORDINATES

Protesters communicating via the most popular but highly censored WeChat app keep information to a bare minimum, according to online discussions of strategy seen by Reuters.

Locations of planned gatherings are given without an explanation, or conveyed with map coordinates, or by a faint map in the background of a post.

"It was in the morning of the 27th that I got this secret clue: 11.27, 9:30, Urumqi office,” said one person who took part in a Beijing protest planned for that day and time outside the Urumqi municipal government office in the capital.

Many people are relying on virtual private network (VPN) software to get past China's Great Firewall and on to encrypted messaging apps.

Tight-knit networks of friends also trade information, adopting a “decentralised” model that some people say was inspired by protests in Hong Kong 2019.

People have set up Telegram groups to share information for their cities, social media users say, while dating app messaging services are also being used in the hope they face less scrutiny, according to one Beijing-based protester who declined to be identified, citing safety.

A few hours before protesters gathered in cities like Shanghai and Chengdu, online flyers and pinned locations were widely shared on Telegram groups, Instagram and Twitter, social media users said.

People are also using platforms to share tips for what to do if they get detained, such as how to wipe data off a phone.

Police have been checking phones for VPNs and the Telegram app, residents and social media users said. VPNs are illegal for most people in China.

PARODY

One Twitter account with almost 700,000 followers called “Teacher Li is not your teacher”, has gained lots of attention for posting protest footage from all over China.

At one point on Sunday the account said: "At present, there are over a dozen submissions every second."

Internet users are also attempting to get round the censors with parodies of patriotic posts or ones that show a blank square, a reference to the blank sheet of paper symbol of protest that Chinese people have adopted.

One viral post on China’s all-in-one WeChat app, used by more than a billion people, repeated the word “good” for line after line, apparently mocking the tendency of the authorities and state media to present everything in a positive light.

The post was widely shared before disappearing.

Some WeChat users have posted clips of statements by leaders such as Mao Zedong and Xi voicing support for free speech or popular uprising in speeches made under different circumstances that now seem apt to opponents of zero-COVID.

"Now the Chinese people have organised themselves and are not to be messed with," Xi says in one clip from a 2020 speech commemorating the 70th anniversary of China’s entry into the Korean War that was widely reposted on Monday.

"If you get on their wrong side, it won’t be easy to handle."

“There can no longer be procurements approvals without tender.

“Therefore, I would like to call on all of you to work together as a team. Let’s be committed to save our country,” he said.

KUALA LUMPUR: The cooperation between Barisan Nasional (BN) and Pakatan Harapan (PH) in forming the state governments in Perak and Pahang is based on the principle of bringing stability to the state governments, said BN chairman Datuk Seri Dr Ahmad Zahid Hamidi.

He said it also reflected the reality of a multi-racial society and celebrated diversity in accordance with the states' demographics which are the basis for forming strategic cooperation.

"The cooperation between the two political blocs is an option and this new approach will be a pioneer in forging the unity and harmony of the state governments so that the focus on development can continue," he said in a posting on Facebook today.

Ahmad Zahid said the two coalitions pioneered a new politics-centric path, a path of moderation and maturity, parallel to the formation of a unity government inspired by the Yang di-Pertuan Agong Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah.

The Bagan Datuk Member of Parliament also said even though Perikatan Nasional (PN) refused to join in, the spirit of unity remained the core of the current government.

The UMNO president said this cooperation did not ignore UMNO's principles in any way because the rejection of any collaboration with PKR, DAP and Bersatu before this was merely for the purpose of facing the 15th general election (GE15) and not for post-election.

"The political continuity will not change UMNO's identity and objective of establishing the party that champions the struggle of the Malays and Muslims to empower the nation's progress. In line with this development, it needs to be aligned with the current changes, and dynamics, and be seen as inclusive," he said.

Ahmad Zahid added that UMNO responsibly uses politics to preserve matters related to the interests of the Malay-Muslim race as enshrined in the Federal Constitution.

Datuk Seri Anwar Ibrahim, who is also PH chairman, took his oath of office as the country's 10th Prime Minister on Nov 24 which will see the formation of a unity federal government after the country witnessed a hung Parliament when no party gained a simple majority to form the government following GE15.

ROMPIN: Amanah has decided that its candidate representing Pakatan Harapan (PH) in the Tioman election will give way to the Barisan Nasional (BN) candidate to boost BN's chances of beating Perikatan Nasional (PN).

Amanah secretary-general Datuk Dr Mohd Hatta Md Ramli, in a statement today, said this was a sign of cooperation between PH and BN which was consistent with efforts to strengthen the Pahang and federal unity governments.

"Amanah sees the need to strengthen unity among components of the state government to take on the PN candidate. As such, Amanah, which is a PH component party, has decided to make way for the BN candidate," he said.

The PH election machinery will work with the BN campaign to ensure victory for the BN candidate, he added.

Polling for the Tioman state seat under the 15th General Election (GE15) was postponed to Dec 7 after PN candidate Md Yunus Ramli, 61, died on polling day on Nov 19, believed due to a heart attack.

PH's Mohd Fadzli Mohd Ramly is in a five-cornered fight with BN's incumbent assemblyman Datuk Seri Mohd Johari Hussain, Osman A Bakar (Pejuang), Sulaiman Bakar (Independent) and Nor Idayu Hashim (PN), who replaced Md Yunus.

Tioman has 28,465 voters, comprising 28,200 ordinary voters, 262 police personnel and three absentee voters abroad.

Mohd Fadzli had earlier said he was willing to give way to the BN candidate if directed by the PH leadership.

GE15 left a hung state assembly in Pahang after no party or coalition won a simple majority, with PN taking 17 seats, BN (16) and PH (eight).

BN and PH then decided to work together to form a unity government.

PM seru kakitangan awam bawa perubahan pada negara

November 29, 2022

Justeru, beliau menyatakan, seluruh penjawat awam perlu menerima hakikat bahawa negara sememangnya memerlukan perubahan.

Ini termasuk perubahan dari sudut kepimpinan.

"Keadaan mesti berubah. Perubahan itu dari kepimpinan termasuk dari perkhidmatan awam, kementerian, dan jabatan yang harus terima perubahan.

"Tidak mungkin saya berjaya sekiranya tunggak perkhidmatan awam tidak sepenuhnya bersama saya," katanya lagi.

'Ismail Sabri pernah tolak guna kenderaan kalis peluru'
