The court rejects senior police officer's remand application


KUANTAN - The Kuantan Magistrate's Court, today, rejected the remand application against a senior police officer who was arrested by the Malaysian Anti-Corruption Commission (MACC) yesterday.


Magistrate Tengku Eliana Tuan Kamaruzaman rejected the application for remand on the grounds that the MACC arrested the suspect under Section 117 of the Criminal Procedure Code (KPJ) which should have been used under Section 49 of the MACC Act 2009.

The application proceedings were conducted by the MACC Deputy Prosecutor, Rifah Izzati Abdul Mutalif while the suspect was represented by the defense attorney, Datuk Bob Aramugam.

According to the advocate, the court cannot use Section 117 of the KPJ for MACC cases as the commission has to use its own act related to MACC cases.

Bob Arumugam when met said the MACC can require the suspect to sign a bond or bail if they are unable to complete the investigation.

"MACC only had 24 hours to complete their investigation before releasing the suspects, after their remand application was rejected by the court.

"This means MACC can detain my client until 4pm this afternoon for investigation purposes," he said.
