Ebit Lew case: Witness analysis of Whatsapp group chat video, pornographic images

LATIFAH Abdul Aziz appeared as a witness in the trial of the Ebit Lew case at the Tenom Magistrate's Court today

TENOM: The seventh witness in the trial of the sexual harassment case involving the famous preacher Ebit Lew or his real name is Ebit Irawan Ibrahim Lew, 37, today told the court that another cell phone, the OnePlus type, which was analyzed had a video showing a conversation in a WhatsApp group containing sexual or obscene images. .


PDRM Audio Video Investigation Senior Analyst, Assistant Superintendent Latifah Abdul Aziz, 43, said the video of the conversation in the Whatsapp application was released from a OnePlus mobile phone marked S1 on 22 October 2021.


"I removed the case item (OnePlus mobile phone) to be analyzed on October 22, 2021.


"After completing the analysis process, I found a video related to the investigating officer's application and I copied the video on a compact disc (CD) to be supplied to the investigating officer.


"I submitted the analysis report to the Investigating Officer Superintendent Noor Asyikin on 26 October 2021 as well as the declaration form for handing over the case goods signed between me and Superintendent Noor Asyikin," She said at the Magistrate's Court today.


According to Latifah, as a result of the analysis carried out, she found a video showing a conversation in the WhatsApp group application containing sexual images related to the request of the investigating officer.


Responding to Deputy Public Prosecutor Nor Azizah Mohamad's question if the case item was removed from the time it was received on 8 October 2021 until the date of analysis on 22 October 2021, the seventh witness told the case item that the OnePlus mobile phone marked S1 was never removed from the cabinet where it was kept in a room in his office.


However, the witness did not have time to explain the content of the video obtained from the OnePlus mobile phone today due to his health condition which does not allow him to continue testifying.


In the meantime, while answering Deputy Public Prosecutor Zahida Zakaria's question about the two identical photos in the mobile phone marked NA-1, Latifah said, from the metadata released, the two photos were in two different folders 


She said, from the metadata released, the two pictures are in the Whatsapp Images folder and the sent folder and it shows that both pictures have been sent or shared by the mobile phone user.


She explained that phone users have shared the same picture twice based on different picture sizes.


In the previous hearing, the court recorded that the Samsung Galaxy A31 mobile phone marked NA-1 was the phone seized from the complainant in the case in question.


Taking note of the unwell condition of the witness, Magistrate Nur Asyraf Zolhani adjourned the trial today and the trial will continue as previously agreed which is on 16 to 18 August. A new date has also been set which is September 26 to 29.


Ebit is facing 11 charges of sexual harassment which is sending obscene pictures and words with the intention of humiliating a woman's honor through the Whatsapp application which allegedly took place in Tenom district between 29 March to 18 June 2021.


For that offence, Ebit was charged in accordance with Section 509 of the Penal Code which provides for a prison sentence of up to five years, a fine or both for each charge.


936 screenshots of browsing history on porn sites obtained from phone, court told


TENOM: A witness in the trial of preacher Ebit Irawan Ibrahim Lew or Ebit Lew told the Magistrate's Court here that a total of 936 screenshots of browsing history on pornographic websites were obtained from her analysis of a mobile phone.


Royal Malaysia Police (PDRM) senior audio-video analyst ASP Latifah Abdul Aziz, 43, said of the total, 146 screenshots were obscene.


"I request for the court to refer to the first and last screenshots, the period of the (search) history that was successfully identified was from June 14, 2020, to Aug 19, 2021," said the seventh prosecution witness on Thursday (June 22).


ASP Latifah told the court that she was instructed to analyse another mobile phone and found eight pornographic images, adding that the images were taken from the WhatsApp application.


On Wednesday (June 21), the witness told the court that the websites were accessed from the Google application.


The accused lawyer Ram Singh objected to questions by the prosecution to the witness regarding Google search history, saying there was no evidence in Google search history that a site was visited as testified by the witness.


He said there were too many searches made on the handphone analysed by the witness, adding they were irrelevant to the charges.

Deputy public prosecutor Zahida Zakaria said the prosecution wanted to submit evidence relevant to the charges referring to obscene Google searches on the dates of the charges.


Zahida said the testimony was important to show the actions and circumstances of the accused on those dates, adding that he had browsed the websites before sending obscene messages to the complainant.


Ebit Lew, 37, faces 11 charges, including insulting the modesty of a woman in her 40s by sending obscene words and pictures to the victim’s phone number via the WhatsApp application between March and June 2021.


The charge under Section 509 of the Penal Code provides for a prison sentence of up to five years, or a fine or both, upon conviction.
