The parents of Zayn Rayyan pleaded not guilty to the charge of neglecting the child in a manner likely to cause him physical injury.


 

The parents of Zayn Rayyan Abdul Matiin pleaded not guilty in the Sessions Court here today, to the charge of neglecting the child in a manner likely to cause him physical injury.

The incident involving the six-year-old autistic child allegedly happened at Apartment Idaman, Damansara Damai, on December 5 last year.

Ismanira Abdul Manaf and Zaim Ikhwan Zahari, each 29 years old, made the confession before Judge Dr Shahliza Warnoh just now.

According to the charges, Ismanira and Zaim Ikhwan are charged under Section 31(1)(a) of the Children Act 2001 and can be punished according to Section 31(1) of the same act, read together with Section 34 of the Penal Code, which can carry a maximum fine of RM50 ,000 or imprisonment for not more than 20 years or both, if convicted.

Ismanira and Zaim Ikhwan are accused of neglecting Zayn Rayyan in a way that may cause him to suffer physical injury between 5 Dec 2023 at 12 noon and 6 Dec 2023 at approximately 9.55 pm, around the area of ​​Jalan PJU 10/1 Damansara Damai.

The prosecution team led by Selangor State Director of Prosecutions Ku Hayati Ku Haron proposed bail of RM15,000 for each accused with one surety and requested both accused to report to the nearest police station every month.

However, their lawyers, Mahmud Abdul Jumaat and Fahmi Abd Moin, requested that the bail costs be reduced because both accused are under extreme pressure and need to cover the high cost of treatment besides Zaim Ikhwan who works as the sole sponsor of the family.

"Since the six months this case has been going on, the two accused have also provided excellent cooperation to help the police's investigation," said Mahmud.

Shahliza allowed the two accused to be bailed at RM10,000 with one surety for each.

This is on the condition that the two accused report themselves at the police station near the house on every 1st day of the month and are not allowed to disturb the witnesses of the case until the case is finished.

The court also imposed a ban on the parties involved in the case from issuing any statements during the course of the case.

The court set the date for mention of the case on July 26, 2024.
