KULAI: The act of uploading and spreading obscene content is an offense under Section 233 of the Communications and Multimedia Act, said Deputy Communications and Digital Minister Teo Nie Ching.
Accordingly, he advised that all parties be more careful in uploading or sharing inappropriate content to avoid being subject to legal action.
"If we refer to Section 233 of the Multimedia and Communications Act, it is stated that improper use of network facilities or network services is indeed an offence, for example obscene content, painful content, threatening to disturb others and so on.
"If someone uploads (such) content (through) social media, it is indeed one of the improper uses and can be investigated under Section 233 of the Communications and Multimedia Act," he told reporters when attending the One-Time Action Communication Program (KOMTIS) and Council Breaking the fast at Balai Raya Felda Bukit Batu, here, today.
He said this when asked about the actions of individuals who uploaded and spread a video of a young couple doing obscene things in a car, which went viral on social media, recently.
Teo, who is also the Member of Parliament for Kulai, said that his side through the Communications and Multimedia Commission (SKMM) would cooperate with the Royal Malaysian Police (PDRM) to identify individuals who uploaded such inappropriate content.
He said, if found guilty, the party concerned could be fined RM50,000 or imprisoned for a year or both.
Last Thursday, a 22-year-old man and a 17-year-old girl were arrested for allegedly committing lewd acts in a vehicle in Taman Kota Masai, after their video went viral.
Those believed to be lovers were then remanded for two days, before being released on police bail while the police continued to investigate the case to be referred to the Deputy Public Prosecutor's Office.
