Petaling Jaya: The biological mother and her boyfriend were charged in the Magistrate's Court here today on charges of killing a five-year-old boy last month.

However, no confession was recorded from Mary Teh May Yee, 44, and S Puvaneswaran, 29, as the murder case is under the jurisdiction of the High Court.

According to the charges, they together killed the boy, Teh Joseph at home in Taman Puncak Jalil, Seri Kembangan at 12.55 midnight, last August 22.

Therefore, the woman who is also unemployed and her lover are accused of committing an offense that can be punished according to Section 302 of the Penal Code and read together with Section 34 of the Penal Code which if convicted can be punished by hanging to death.

In the same proceedings, Puvaneswaran, who is also a lorry driver, pleaded not guilty to the charge of giving a false written statement against a police officer, Constable Rashmit Kaur Harpajan Singh.

The action caused the investigating officer, Assistant Superintendent Che Ashru Nizam Che Abdul Rahman to conduct an investigation where it would not have been necessary if the true circumstances of the incident had been informed to the accused.

The offense was allegedly committed at the Seri Kembangan Police Station, near here, at 2.57am on August 22 according to Section 182 of the Penal Code which carries a maximum prison sentence of six months or a fine of up to RM2,000 or both, if convicted.

Deputy Public Prosecutor Nurul Sofea Jaysal did not offer any bail because the murder case is a non-bailable offense while the two accused were not represented by a lawyer.

Magistrate Shahril Anuar Ahmad Mustapa fixed October 2 next for the mention of all cases.

Previously, it was reported that a five-year-old boy died believed to be the victim of abuse by his biological mother and her boyfriend after being taken to the Emergency Department, Serdang Hospital in an unconscious state.

The two suspects also made a false police report stating that the child had been hit by a lorry, but the investigation found that the reported incident did not happen.
