Prosecution to appeal against sodomy case cop’s 100-year jail sentence

PUTRAJAYA: The Court of Appeal has fixed March 23 for the prosecution to raise a preliminary objection in the case of a 57-year-old former police officer who was sentenced to a total of 100 years in jail and 15 strokes of the cane for raping and sodomising a 13-year-old girl.
Justice Mohd Zawawi Salleh set the date Tuesday after DPP Hamdan Hamzah told the court that he would like to raise the objection because the defence had not filed a petition of appeal.
He added that the court could strike out the appeal if a petition was not filed.
Justice Mohd Zawawi then said he would give an opportunity for Geethan Ram, the counsel for former Sabah police anti-vice chief Deputy Supt Rohaizat Abd Ani (pic), to file a petition as he was on medical leave Tuesday.
He also asked lawyer Jaswin Rajendiran, who appeared on behalf of Geethan, to produce Geethan's medical certificate.
Jaswin applied for a postponement after he told the court that Geethan was unable to be present because he injured his leg on Monday night.
On Dec 23, 2015, the Kota Kinabalu Sessions Court found DSP Rohaizat guilty of raping and sodomising the girl.
He was found guilty of four counts of rape and one count of sodomy committed in five separate incidents between February and May 2012.
Sessions judge Ainul Shahrin Mohamad had imposed the maximum 20-year jail term for each offence.
DSP Rohaizat was serving as the deputy chief of the Federal Reserve Unit in Penang when he was charged in August 2013, and he has since been suspended.
He  will have to serve a total of 80 years as the sentence for the first two charges were to run concurrently and the remaining three charges to run consecutively.
The court however granted a stay and fixed bail at RM100,000 with one local surety and directed DSP Rohaizat to surrender his passport to the court.
He was also directed to report to the police on the 1st and 15th day of each month.
