An elderly man and his stepson pleaded not guilty in the Sessions Court here on Sunday to the charge of raping a teenage girl in a car in Kluang, six years ago.
The 77-year-old accused, who is in a wheelchair and his 21-year-old son, pleaded not guilty as soon as the charge was read before Judge Abu Bakar Manat.
According to the charge sheet, his son, who worked as a courier, was accused of raping a teenage girl who was 15 years old at the time in Jalan Kinabalu, Kluang at 5.15pm, 25 May 2017.
While his father is accused of committing a cursed act against the same victim an hour apart in an open area in Kampung Abdul Rahman Yasin, Kluang at 6pm, in a car on the same day.
Both accused are charged with committing an offense according to Section 376 (3) of the Penal Code which can be punished with imprisonment of up to 30 years and 10 lashes.
The case was handled by the Deputy Public Prosecutor, Danial Munir, while the two accused were not represented by lawyers.
The court then imposed bail of RM12,000 on the 21-year-old accused and RM15,000 on the elderly.
Abu Bakar also ordered the accused to be bailed with a surety and to report to the Kluang Police Station every month.
