Ex-driver to Suhakam chairman jailed 36 months, fined 45,000 for forgery

KUALA LUMPUR: A former driver to Human Rights Commission of Malaysia (Suhakam) chairman Tan Sri Razali Ismail was sentenced here to 36 months in jail, a RM45,000 fine and a stroke of the cane for forging 24 bank cheques and cashing out more than RM700,000 belonging to his ex-boss.
Mohamad Faisal Mohamad Sanusi, 31, was also ordered to serve an additional 45 months in jail if he fails to pay the fine.
The father of three admitted on Thursday (March 1) to 24 counts of forging the cheques amounting to RM762,706 with the intention to deceive the banks.
He committed the offences at Maybank branches in Wangsa Maju and Ampang Park, and at a Standard Chartered branch in Jalan Ampang between Aug 4, 2016 and Nov 5, 2016.
The charges under Section 468 of the Penal Code carry a maximum seven years imprisonment and a fine.
The accused also pleaded guilty to a count of dishonest misappropriation of property where he cashed a cheque worth RM35,000 belonging to Razali at a Standard Chartered branch at Jalan Sultan Ismail on Oct 31, 2016.
The offence under Section 403 of the same Code carries a maximum five-year jail term, whipping and a fine.
Mohamad Faisal cried as he pleaded for leniency before magistrate Maizatul Munirah Abdul Rahman.
"I know what I did was wrong. I did all that out of anger and spite after I was fired," he said.
DPP Noorelynna Hanim Abd Halim asked the court to consider the fact that the accused had committed a crime against his own employer and mete out a just sentence.
Magistrates Siti Radziah Kamarudin and Mahyudin Mohmad Som also presided over the cases as the charges were divided between the three magistrate's courts.
DPP K. Vasugi and Farah Adilah Noordin appeared for the prosecution in their respective courts.
Lawyer M. Segaran appeared to hold a watching brief for Razali.
The accused did not pay the fine.
The jail sentence is to run from the date of arrest on Feb 25
