Court dismisses appeal of convicted ex-doctor for molesting his patient

   
SHAH ALAM: A High Court here has dismissed an appeal by a former doctor against the decision by Kajang Magistrate’s Court which convicted him with two counts of molesting his patient in Kajang Hospital three years ago.
High Court judge Justice Nor Azian Shaari rejected the appeal filed by Dr Ahmad Hisham Ahsan, 44, on grounds that there was no merit in his application.
Justice Nor Azian said there was no reason why this court should interfere with the Kajang Magistrate's Court decision, which was based on the right grounds of law.
On Wednesday, the High Court upheld the sentences meted out by Magistrate Abdul Jalil Salam Muhamad who jailed Dr Ahmad for seven years and also ordered him to be whipped two times on Feb 8, last year.
Magistrate Abdul Jalil made the ruling after Dr Ahmad was found guilty and convicted to the charges by end of defence case.
He sentenced Dr Ahmad to seven years' jail and ordered to be caned once for each of the charges. However, he instructed the jail sentences for both charges to run concurrently from the date of judgement.
Meaning, Dr Ahmad would serve only seven years in prison and to be whipped twice.
Dr Ahmad had pleaded not guilty to two counts of molesting his 19-year-old patient by fondling her breasts and touching her private part respectively.
The offences were committed at Ward 4 of the Kajang Hospital between 3.15am and 4am on Dec 25, 2011.
