Dad Appears in Syariah Court After Seing sued For Maintainence

Errant dad finally appears in Syariah Court to face child maintenance claims


KUALA TERENGGANU: A 40-year old oil drilling manager appeared for the first time at the Kuala Terengganu Syariah High Court here today, three years after his father filed child maintenance claims amounting to RM18,000.

His 67-year old father Mustafa Ismail had obtained a court order from the Syariah High Court here after Nasrun failed to make any child support payment for his two children, who had been living with Mustafa for the last eight years.

The court had ordered Nasrun, who was a manager with an oil and gas company with a monthly pay of RM17,000, to pay RM400 a month to each of his parents and children, aged 15 and 17, apart from RM1,000 for Hari Raya expenditure for his children each year.
The court also ordered Nasrun to pay RM18,866.50 in arrears and exemplary damages for failing to see his children for more than eight years.
On July 29, the court issued an arrest warrant on Nasrun when he failed to comply after more than 10 months.
At the court today, Nasrun promptly paid RM10,000 in arrears to Mustafa and mother Che Mariam Abdullah, 59, after judge Rosdi Harun ordered him to do so before 3pm for face a week in jail.
Rosdi also ordered Nasrun to pay the remaining RM11,000 claims to his parents by installments.
Mustafa, from Kampung Beladau Kolam in Manir here, told the court that he would not mind seeing his son sent to jail as a lesson for neglecting his parents and two children who are in their care.
 
"Yang Arif, saya reda mempunyai anak seperti ini..saya reda dia dipenjarakan (I accept having a son who is like this..I accept (if) he is jailed a week or more," he said.
Mustafa also voiced his doubts on Nasrun's sincerity in declaring in court that he was sorry.
"I have been sitting here all this while and he did not even acknowledge me," he complained to Rosdi.
 Rosdi then advised the family to work towards a reconciliation and reminded Nasrun that he should sincerely seek his parents' forgiveness since their blessings is a pre-quisite to be allowed into heaven.
 
"In this case, I am not in a position to decide who is right and who is wrong but I hope everyone involved will work towards reconciliation," he said.
 Rosdi allowed Nasrun a bail of R1,000 with two sureties pending hearing on Nov 24 for him to enter his defence after Mustafa filed an application for him to be jailed for not adhering the court order to pay RM18,866.50.
 
Nasrun told the court that his did not want to appear in court before because he did not want to fight his parents in court.
 
"I don't want to fight them in court. I have no intention to go against them," he said.
 
The case received much publicity when Mustafa filed it in 2010 against his son who was said to have a RM17,000 monthly salary, claiming that he had abandoned his children under the parents care after re-marrying.
