Family to sue over pile driver mishap

KLANG: The family of the couple who were killed after a pile driver hit the car they were in is set to take legal action against those responsible.
Mohamad Zahidin Abd Rahim said the family would be appointing a lawyer soon to proceed with the case.
“My siblings and I have discussed the matter and we are certain that we will sue the party or parties responsible for the site’s safety.
“We want justice for our parents. This should also serve as a lesson to all to not take safety lightly,” he said yesterday.
Mohamad Zahidin’s father Abd Rahim Abd Rahman, 51, and stepmother Nurhayati Rosli, 46, were killed in a freak accident when a pile driver at a nearby construction site toppled onto their car along Persiaran Astana in Bandar Bukit Raja, Meru, near Klang, at around 12.30pm on Friday.
Initial investigations by the Selangor Fire and Rescue Department suggested that the pile driver was not placed on solid ground which could have caused it to tip over.
Mohamad Zahidin, 32, a soldier, said the family accepted the tragedy as fated but those responsible “must not be let off unpunished”.
The construction site next to the scene was part of the ongoing West Coast Expressway project, which will link Teluk Intan, Perak with Banting, Selangor by concessionaire WCE Sdn Bhd.
The concessionaire, in a statement on Friday, confirmed that the boom median of a hydraulic spun pile machine at the site had overturned and fallen onto a passing car along Persiaran Astana.
They are working with the authorities to investigate the incident.
Work at the site has been ordered to stop immediately.
Mohamad Zahidin noted that representatives from both the concessionaire and contractor had gone to the Hospital Tengku Ampuan Rahimah mortuary here on Friday to meet the family.
“They extended their condolences and offered some contribution. The representatives from the concessionaire even accompanied us until the burial was completed (at Felda Titi in Jelebu, Negri Sembilan) on the same night.
“However, our decision to sue those responsible remains unchanged because two lives have been lost,” he added.
Meanwhile, North Klang OCPD Asst Comm Mohd Yusoff Mamat said police had summoned the pile driver operator, construction site supervisor and health and safety supervisor to have their statements recorded.
He said the operator, a 46-year-old Malaysian, suffered a broken leg and was warded a day at the hospital.
“He jumped from the pile driver after it collapsed and broke his left leg,” he said.
Upon his discharge from hospital, the man went to the district police headquarters. He was released on police bail after questioning.
The case is being investigated under Section 304 of the Penal Code for causing death by negligence not amounting to culpable homicide.
Selangor Mentri Besar Datuk Seri Mohamed Azmin Ali called for a thorough investigation and those responsible to be brought to book.
