Section 4(3) of Sosma states that “No person shall be arrested and detained under this section purely for his political belief or political activity”,

Section 4(3) was drafted for this very specific reason that this act will never be used to suppress someone for their political belief or activity especially those who oppose the government.

The Cabinet has to step in on this matter, common sense must prevail


Cops need to explain Sosma use against Maria: Wanita MCA

KUALA LUMPUR: The police should justify the arrest of Bersih 2.0 leader Maria Chin Abdullah under the Security Offences (Special Measures) Act 2012, says Wanita MCA.

Its chief Datuk Heng Seai Kie (pic) questioned whether Sosma was the appropriate legislation to use in this case.

“What is the reason for her to be arrested under Sosma?” she said at a press conference here Tuesday.

“Personally, I and all of Wanita MCA are wondering (about this), so I think the police should justify it to the public,” she added.



However, Heng said that the police, who abide by the law, must have a “solid reason” for arresting Maria using the anti-terrorism act.

“What we need to see is the report from the investigation … (and) the information that was gathered from her interviews and from Bersih 2.0, since her arrest was only changed to Sosma after the Bersih 5 rally on Saturday.

“There must be a reason ... but they need to explain why,” she stressed.

Besides Sosma, Maria was also detained under Section 124C of the Penal Code that involves activities deemed detrimental to parliamentary democracy.

Heng however said she hoped Maria would be released soon if proven innocent.

Maria was among the leaders arrested on Friday in a police sweep ahead of the Bersih 5 rally on Nov 19.

Others arrested include Red Shirts leader Datuk Seri Jamal Yunos, who has since been released, Bersih 2.0’s Mandeep Singh, and activist Hishamuddin Rais.
