GEORGE TOWN: A senior female police officer, sentenced to three-and-a-half-years in jail by a magistrate’s court for releasing an alleged serial Casanova swindler, has been granted a stay of execution.
High Court Judicial Commissioner Datuk Azmi Ariffin yesterday allowed the application by Asst Supt L. Chandkumary’s (pic) counsel Dr N. Ahilan, pending the hearing of an appeal proper at the High Court.
JC Azmi took into consideration ASP Chandkumary’s medical condition, which included major depression and the recommendation by specialists for her to undergo further forensic psychiatric assesment.
However, the police officer is subjected to three conditions.
Her bail amount has been increased from RM7,000 to RM10,000.
She must also surrender her passport and other travel documents, as well as report to the nearest police station once every three weeks.
On Jan 29, ASP Chandkumary, 57, was found guilty of releasing computer technician K.K. Prabaharan, 47, who was in her custody, at the George Town court complex at 1.50pm on Oct 9, 2013.
The offence under Section 225A(1)(a) of the Penal Code, carries a jail term of up to three years or a fine, or both.
She was also found guilty of lodging a false police report at 8.05pm on the same day, claiming that Prabaharan disappeared when she was writing down remarks on the case at her office, while waiting for the case to be mentioned in court.
The offence under Section 182 of the Penal Code, carries a jail term of up to six months or a fine of up to RM2,000, or both.
Magistrate Dianne Ningrad Nor Azahar had sentenced Chandkumary to three years’ jail for the first charge and six months’ jail for the second.
