KUALA LUMPUR: A man was sentenced to a total of four months' jail by the Magistrate's Court on Thursday after he pleaded guilty to two counts of making video recordings of two women, who were bathing in their respective bathrooms, using a handphone.
Magistrate Nur A'minahtul Mardiah Md Nor sentenced Zulkarnaen Toharudin, 27, to two months' jail on each count, to be served concurrently.
On the first count, Zulkarnaen, a self-employed, was charged with using a handphone to make a video-recording of a 37-year-old woman who was bathing in a bathroom, with the intention of outraging her modesty.
The offence was committed at a unit of the People's Housing project (PPR) in Sentul at 6.15am on Dec 28, 2013.
He was also charged with committing a similar offence on a 46-year-old woman at the same PPR at 6.30am last Jan 28.
Both the charges were made under Section 509 of the Penal Code, which provided an imprisonment for a term of up to five years or fine or both, upon conviction.
According to the facts of the case, a man, who is a friend of the 37-year-old woman's husband, saw the video recording and informed the matter to the woman's husband.
The woman's husband then seized the memory card from the phone and found a video-recording of his wife bathing. There was also a video-recording of the 46-year-old woman bathing.
In mitigation, Zulkarnaen said it was his first offence and promised to not do it again.
