Appeals Court upholds conviction on man for committing unnatural sex

   
PUTRAJAYA: The Appeal Court upheld the conviction and 13-year jail term imposed on a man for committing unnatural sex with a woman, including inserting various objects into her vagina, three years ago.

A panel headed by Court of Appeal judge Datuk Abdul Wahab Patail, unanimously dismissed the appeal by P.G. Selvaganesan, 25, against the decision of the Taiping Sessions Court which found him guilty.

Selvaganesan, who was working with his brother at a workshop at the time of the incident, was alleged to have committed the offence on the woman, who was then 19 years-old, at a house at Jalan Simpang, Taiping, Perak between 8.30pm on July 3, 2011 and 1am on July 4, 2011.

Selvaganesan was charged under Section 377CA of the Penal Code which carries a maximum imprisonment for 20 years and whipping, if found guilty.

According to the facts of the case, on the day of the incident, the victim, then a college student, went to meet a college friend to go to Penang to celebrate another friend's birthday. Selvaganesan and a few others went with them.

After the birthday party, the victim, with her eyes covered, was taken by force to a house where there were a few other men.

The victim was slapped and threatened that she would be killed if she tried to escape.
After which, she was raped by a few men there before Selvaganesan inserted a mineral water bottle and an empty liquor bottle into her vagina. He also poured some ointment on her vagina and then sprayed Ridsect on her body.
Selvaganesan was represented by lawyer Amir Faliq, while prosecution was conducted by deputy public prosecutor Andi Razalijaya A. Dadi. - Bernama
