Judge says the four offences the youth committed are serious and he may have detonated the explosives at a public place had he not been arrested.




KUALA LUMPUR: A 20-year-old youth was ordered to serve nine years in jail by the High Court here today after he pleaded guilty to four terrorism-related charges, including planning to bomb the Better Beer Festival 2017.

In his judgment, Judge Mohd Sofian Abd Razak, said the jail sentence meted out on Mohd Hafizi Mat Jusoh for each charge was deemed appropriate as the offences were serious.

“Maybe, if he was not arrested, he might have detonated the explosives at a public place,” he said.

Hafizi was sentenced to nine years’ jail for the first charge, five years for the second, and three years for the third and fourth charges.



The judge, however, ordered him to serve the jail sentences concurrently from the date of his arrest on Oct 10, 2017.

The youngest of nine siblings pleaded guilty to the first charge of giving training on how to make explosives through the WhatsApp group chat “The Rise Of Jundullah”, and was prepared to engage in terrorist acts.

The offence was committed in Kota Bharu, Kelantan, between 9.07pm and 10.28pm on Sept 23, 2017.

He also pleaded guilty to the second charge of being present at an open piece of land in Gong Kulim, Pasir Putih, Kelantan, where training was being given for a terrorist act, between 3.30pm and 4pm on Oct 10, 2017.

For the third charge, he pleaded guilty to being in possession of 57 items related to the al-Qaeda terrorist group stored in a mobile phone, at K&K Restaurant, Lot 2689, Jalan Tok Janggut, Kampung Kelubi, Pasir Puteh, Kelantan, at 4.30pm on Oct 11, 2017.

For the fourth charge, he pleaded guilty to displaying 13 videos and five pictures related to the terrorist groups Daesh, al-Qaeda and Jemaah Ansharut Tauhid in his Instagram account on behalf of “al_akh_fillah”, at K&K Restaurant, Lot 2689, Jalan Tok Janggut, Kampung Kelubi, Pasir Puteh, Kelantan, at 4.30pm on Oct 11, 2017.

He was charged under subsection 130F (a), 130FB(1), 130JB (1) and 130JB(1)(a) of the Penal Code, which provides imprisonment of up to 30 years.

Hafizi was represented by lawyer Ariff Azami Hussein, while deputy public prosecutor Muhammad Fadzlan Mohd Noor prosecuted.
