Azalina: Cabinet agrees to amend Article 12(4) of Federal Constitution

     
    KOTA TINGGI: The Cabinet has agreed to amend Article 12(4) of the Federal Constitution to enable it to have a clearer meaning, said Datuk Seri Azalina Othman.  
    The Minister in the Prime Minister's Department said this follows the advice of Attorney-General Tan Sri Mohamed Apandi Ali to amend the provision as the words used in the article were not certain. 
    "According to the A-G, the word 'parent' can be read as mother or father but there were also lawyers who said that the word can mean to include both. 
    She said this after launching a seminar on women and children's rights at Dewan Besar in Bandar Penawar here on Friday.  
    She was asked about the passing of a Bill by Perlis which allows for the unilateral conversion of children by a parent.  
    On Thursday, the Perlis legislative assembly passed amendments to the Administration of the Religion of Islam Enactment 2016.  
    Section 117 was changed, with the phrase in the Malay version reading “father andmother or guardian” to “father or mother or guardian” to give consent for children under the age of 18 to be converted to Islam.  
    Perlis Mentri Besar Datuk Seri Azlan Man, who tabled the amendment, said Section 117 was amended to be consistent with the English version of the Enactment where the word “parent” was used instead of “parents”.  
    He said it was also consistent with the Article 12(4) of the Federal Constitution that says the religion of the person under the age of 18 years shall be decided by his parent or guardian
