KUANTAN: The case of an Indonesian maid charged with hurling and abusing a four-month-old baby boy, which was fixed for retrial at the Sessions Court here today, has been postponed.
Sessions Court judge Nik Nasimah Nik Mohammad fixed Jan 27 to mention the case after being informed that the prosecution, represented by deputy public prosecutor Amir Abu Bakar Abdullah had yet to submit several documents to defence counsel T. Vijayandran.
The maid, Yuliana, from Aceh, Indonesia, had been sentenced to 20 years' jail by the Sessions Court after she pleaded guilty to two counts of abusing the child.
She was charged with throwing and hurling the baby, Mohamed Hareez Mohamed Zamri, nine times, an act which could cause death, at 7.45am on Feb 15 last year at 7, Lorong Bukit Setongkol 38, Jalan Bukit Setongkol here.
Yuliana appealed against the sentence and on Nov 20, High Court judge Datuk Mariana Yahya set aside the Session's Court conviction of Yuliana on the grounds that the maid had not fully understood the charges that were read to her before the Sessions Court judge and ordered a retrial.
