KUALA LUMPUR: An engineer was fined RM1,500 by the Magistrate's Court here today for obstructing the duties of a police officer by refusing to produce identification documents and uttering provocative profanity, three days ago.
Magistrate S. Mageswary handed down the sentence to B. Karthikeyan, 31, who pleaded guilty to the charge and ordered him to serve a month's imprisonment if he failed to pay the fine.
The accused is accused of obstructing Inspector KV. Suresh instead of carrying out his duties refused to present identification documents and uttered provocative words that read, "Eh, you police. U check it yourself" when asked about the police report that had been made.
The offense was committed at the Brickfields District Police Headquarters at 5am, last Saturday according to Section 186 of the Penal Code and can be punished under the same section which carries a maximum prison sentence of two years or a maximum fine of RM10,000 or both, if convicted.
Deputy Public Prosecutor, B. Sareeka asked for appropriate punishment as a lesson to the accused not to commit the same offence.
Lawyer SK Loges who represented Karthikeyan asked for a low fine because his client had to support his family and was remorseful and sorry for what he had done.
"The experience of being remanded for three days has also taught my client a lesson," he said and added that his client had no previous criminal record.
In the same court, Karthikeyan pleaded not guilty to the charge of failing to present identification documents for police inspection, at the same location and date.
The charge is brought under Rule 25 (1) (N) of the National Registration Regulations 1990 which carries a maximum sentence of three years imprisonment or a maximum fine of RM20,000 or both, if convicted.
Mageswary allowed Karthikeyan to be bailed at RM800 with one surety and fixed March 21 for the mention of the case for the submission of documents.
