Ku Nan charged again with accepting RM2 million from developer

(Bernama pic)KUALA LUMPUR: Former federal territories minister Tengku Adnan Tengku Mansor was charged again in the Sessions Court here today with receiving RM2 million from a businessman over land deals involving the Kuala Lumpur City Hall (DBKL).
The Putrajaya MP claimed trial before judge Azman Ahmad.
He was accused of accepting the amount without consideration from Cai Kin Kong through a cheque from Aset Kayamas Sdn Bhd despite knowing that Aset Kayamas, Sinerjuta Sdn Bhd, Fiber Vista Sdn Bhd, Era Ecoland Sdn Bhd, Garuda Searah Sdn Bhd and Ujana Mutiara Sdn Bhd had dealings with his ministry.
The offence was allegedly committed at the Pusat Bandar Damansara CIMB bank branch here on June 14, 2016.
The charge was framed under Section 165 of the Penal Code, under which it is an offence for a public servant to obtain valuables without consideration.
Those found guilty can be jailed for up to two years and fined.
Azman allowed bail of RM500,000 with one surety.
Last month, Tengku Adnan pleaded not guilty before Azman to two counts of receiving RM3 million from two property developers over the land deals.
On the first count, he was accused of receiving RM1 million from developer Tan Eng Boon, who was charged with giving the bribe and abetting Tengku Adnan.
Eng Boon has also claimed trial.
The first charge was made under the Malaysian Anti-Corruption Commission Act, with an alternative charge under Section 165 of the Penal Code.
On the second count, Tengku Adnan was charged with receiving RM2 million from Cai.
Earlier today, deputy public prosecutor Julia Ibrahim successfully applied for a discharge not amounting to an acquittal for the RM2 million case on grounds that the facts of the RM1 million case were different.
Both cases were scheduled to be heard before the same judge.
Lawyer Tan Hock Chuan, appearing for Tengku Adnan, later told FMT that both cases would now be heard before separate judges.
“A judge cannot hear both cases since the facts of the case differ altogether,” he said.
The application to transfer the RM1 million matter to the High Court will be heard on Friday while the RM2 million case has been fixed for mention on Jan 7, 2019.
