Tan Sri M. Kayveas today failed to obtain permission from the High Court here to initiate a judicial review to annul the appointment of Datuk Seri Maglin Dennis D'Cruz as President of the Malaysian People's Progressive Party (myPPP).
Federal Attorney Muhammad Hairuliqram Hairuddin representing the Attorney General's Department (AGC) when contacted said Judge Datuk Amarjeet Singh rejected the application of Kayveas, 69, via email.
Lawyer Syereen Tang, who represents Kayveas confirmed the matter.
On 2 August last, the AGC objected to the application for permission for a judicial review on the grounds that the issue raised by Kayveas could not be reviewed through a judicial review because it was contrary to Section 18C of the Societies Act 1966 and the court had no jurisdiction to review party-related issues.
Kayveas, 69, filed the application on July 7 last naming the Home Minister and the Malaysian Registrar of Societies (RoS) as the first and second respondents.
The application was filed on the grounds that the two respondents failed to take into account that the 67th Annual General Meeting held last March 19 that appointed Maglin as President of myPPP was invalid following the 13 individuals who attended the meeting were stripped of their membership with effect from April 25, 2018 .
Among other things, he requested a declaration that the Annual General Meeting was invalid in addition to claiming that the appointment of Maglin as President of MyPPP was invalid for violating the myPPP Constitution.
The veteran politician also sought an order to overturn the decision of a Home Ministry official through a letter dated April 11 last that approved the party's deregistration appeal.
MyPPP was deregistered on 14 Jan 2019.
