Judgment debtor summons against Watie resolved amicably

KUALA LUMPUR: The judgment debtor summons filed by a former member of the singing group 'Elite', Hana, against group member Watie, was today resolved amicably in the Selayang Sessions Court here.
Hana, as the judgment creditor, filed the suit to demand Watie, as the judgment debtor, to make payment for the overdue debt of over RM700,000 as ordered by the same court on Oct 25, 2017.
The consent judgment was recorded by Judge Nor Rajiah Mat Zin during the proceeding which was held in chambers. Present were lawyer Mohd Fikri Abd Rahman, representing Hana, and lawyer Aqila Zulaiqha Zulkifli, representing Watie, whose real name is Norwati Sadali.
Mohd Fikri, when met by reporters, said that both parties agreed to settle the case amicably and Norwati also agreed to settle the payment requested by Hana.
"The agreed amount is RM796,000, including interest, and Watie will pay in installments of more than RM2,000 a month. Watie will make the payment every month until the full payment is made," said the lawyer.
Mohd Fikri said Norwati would make the payment as previously ordered by the same court.
"The matter is finally resolved amicably to the agreed terms. I request that this case not be prolonged because my client (Hana) agreed to accept the amount proposed by Watie as payment," he added.
Hana, whose real name is Norhanasafiza Mat Adnan, filed the judgment debtor suit against Norwati on May 18, 2017, after the latter failed to pay her damages amounting to RM707,351.83.
In the debtor's suit, Norhanasafiza also sought the court to issue an arrest warrant if Norwati failed to appear in court to explain her failure to pay the debt.
On March 10, 2015, the Selayang Sessions Court allowed a summons suit by Norhanasafiza against Norwati and ordered the latter to pay damages of RM707,351.83.
Norhanasafiza filed the suit after Norwati failed to settle a bank loan, which used her (Norhanasafiza) name for the purchase of a Toyota Wish.
In the statement of claim, Norhanasafiza stated that she had obtained a loan for RM150,000 for the purchase of the car in September 2005 on behalf of Norwati because the latter was not eligible to apply for a loan.
However, she said, after getting the car, Norwati failed to comply with the stipulated conditions, including paying the loan installment since September 2010.
As a result, Norhanasafiza said she was declared bankrupt on April 1, 2013.
