Action Can be Taken Against Individuals Not Complying to the Home Monitoring and Surveillance Order for COVID-19

As previously informed by the MOH, the Home Monitoring and Surveillance Order (HSO) has come into force under the Prevention and Control of Infectious Diseases Act 1988 [Act 342] since 10 June 2020. This was in accordance with the Recovery Movement Control Order (RMCO).

The number of Persons Under Surveillance (PUS) that have been discharged from quarantine centres on 10 June 2020 and subsequently placed under the HSO were 5,909 individuals, to complete the 14-day quarantine period. However, out of these, only 4,437 individuals were recorded to have undergone COVID-19 testing at health clinics or private clinics on day 13 of the quarantine. Of those tested, three (3) confirmed COVID-19 cases were detected. Therefore, a total of 1,472 individuals are still required to undergo COVID-19 testing on day 13.

MOH would like inform that all individuals returning from overseas (including Malaysians, permanent residents and those who are allowed to enter for work) are required to undergo compulsory home quarantine at their respective residence for 14 days as stated in the Guideline for the Home Monitoring and Surveillance Order (Annex 14b).

Individuals placed under this Order are also required to comply to certain conditions and actions as outlined in the COVID-19 Management Guideline in Malaysia No.5/2020 (Annex 10a and 10b: Home Assessment Tool). Some of the conditions set are as follows:

  • Wear a facemask all the way from the International Ports of Entry to their residence.
  • If symptomatic, to contact the nearest District Health Office.
  • The HSO bracelet must be worn at all time throughout the HSO.
  • Undergo COVID-19 testing on day 13 of the quarantine at a nearby health clinic or private clinic accredited by MOH and obtain a copy of the results.
  • On day 14, to go to the nearest District Health Office with the COVID-19 test results to be released from the HSO, and the remove the HSO bracelet.

The Government views very seriously compliance to this Monitoring and Surveillance Order. Please be advised that failure to comply with this Order and the conditions contained therein is an offense under Section 22 of Act 342. If convicted of this offense, the individual concerned may be liable under Section 24 of Act 342.

The District Health Office and other related agencies involved have been authorised to seek and take action against individuals found to be in violation of the terms of this Order. They can be fined or imprisoned or both.

Accordingly, MOH urges all travellers returning to Malaysia to continue to cooperate with the MOH and comply with the conditions under this Order. Family members of individuals placed under the HSO must also play their role in advising and ensuring that these individuals remain compliant and that they do not violate any directives that could result in legal action. The cooperation of all parties is important to enable us to jointly break the COVID-19 infection transmission chain in Malaysia.
