Court orders IGP to arrest Indira Gandhi’s ex-hubby and find child


IPOH: The Ipoh High Court has granted kindergarten teacher M. Indira Gandhi a mandamus order to compel Inspector-General of Police Tan Sri Khalid Abu Bakar to arrest her Muslim convert ex-husband and to find her youngest child. 
Justice Lee Swee Seng granted the order on Friday following a judicial review application against Mohamad Riduan Abdullah and gave seven days for it to be executed.
On Wednesday, the Court of Appeal threw out all appeals and applications before it in the custody case against Indira's ex-husband.
The panel of judges led by Justice Balia Yusof Wahi ruled that those appeals could not be heard by the court until contempt proceedings involving Mohamad Riduan were “purged’’ at the High Court level. 
The panel threw out two other matters and struck out the main appeal before it. The main appeal is a citation for contempt against Mohamad Riduan for refusing to return his daughter to Indira Gandhi.
The two matters are applications by the Attorney-General’s Chambers and Mohamad Riduan for extension of time to file a memorandum of appeal. Justice Balia Yusof said a person’s appeal could not be heard by the court until he had purged his contempt case.
In the custody tussle between Mohamad Riduan and Indira, the Ipoh Syariah High Court had on Sept 29, 2009 granted custody of their three children to the father. However, the Ipoh High Court on March 11, 2010 allowed the children to be under Indira’s care with once-a-week access given to the father.
When he failed to return one of his two daughters, Prasana Diksa, to his wife, the court cited him for contempt and ordered the police to return the child to the mother.
On June 26, Attorney-General Tan Sri Abdul Gani Patail and Inspector-General of Police Tan Sri Khalid Abu Bakar applied to be made parties in the custody battle. Khalid said the police were in a quandary because there were two custody orders, from the High Court and the Syariah High Court, and executing one would mean showing disrespect to the other.
