‘Najib not the only exemption’

KUALA LUMPUR: Datuk Seri Najib Tun Razak is not the only politician spared from wearing the anti-graft agency’s orange lock-up attire, it has been pointed out.

Malaysian Anti-Corruption Commission (MACC) deputy chief commissioner (operations) Datuk Seri Azam Baki said the use of lock-up attire and handcuffs for suspects in corruption cases was at the discretion of the investigating officer.


“Najib is not the only one who wasn’t subjected (to it). Many others have also not been made to wear them. People ask why.


“It is the discretionary power of the investigating officer,” he was quoted as saying on the MACC talk show aired over Bernama radio yesterday.

The former prime minister first appeared in court on July 4 to face three charges of criminal breach of trust and one for abuse of power relating to funds involving former 1MDB subsidiary SRC International Sdn Bhd.

On Aug 8, Najib was charged with three counts of money laundering amounting to RM42mil.

On all the occasions, he was wearing a suit and tie, instead of the orange MACC garb.

Azam clarified that investigating officers had discretion to decide whether arrested individuals should be made to wear the orange uniform.

“Many people have raised this question.

“So I would like to state that there are many who wore it and many who did not.

“It is up to an investigator’s discretion on whether there is a need to wear certain clothes,” he told a caller who inquired about Najib’s Thursday court appearance.

On the criteria investigating officers use to decide on the attire of a suspect, Azam said several aspects were taken into consideration, including the risk of an individual escaping and blending into a crowd.

“In ordinary circumstances, if the person is deemed to have potential risks, he will be made to wear the orange uniform. So it is on a case-by-case basis,” he said.
