GEORGE TOWN: The High Court here has upheld the sentence against a former Veterinary Department officer, who was found guilty of assaulting his wife in a hospital lift.
Mohammad Affandi Ismail (pic), 40, was sentenced to eight months' jail and a fine of RM2,000, or two months' jail in default, by a magistrate's court in 2016.
Judicial Commissioner Datuk Abdul Wahab Mohamed said Monday that he found no reason to interfere with the judgement of the magistrate's court.
He further rejected a stay of execution, pending an appeal to the Court of Appeal.
The accused was represented by counsel R. Palaniappan while DPP Jailani Abdul Rahman prosecuted.
Later outside the courtroom, Palaniappan said his client had told him not to appeal the case to the Court of Appeal and that he would like to serve his sentence.
Affandi was found guilty of committing the offence at about 4pm on Aug 21, 2013, at the KPJ Hospital in Bandar Perda.
