KUALA LUMPUR: A mechanic at a bicycle shop was sentenced to a total of 12 years' jail by a Sessions Court here for two counts of attempting to murder his girlfriend's daughter and her neighbour's daughter two months ago.
Sessions Court judge Ahmad Bache jailed Mohd Afizi Abdul Rahman (pic) to 12 years for attempting to murder Saliza Saidin's daughter Nur Airis Qaliesha Mohd Shahril, two, and Saliza's neighbour two-month-old daughter Nur Dia Syazana each.
Judge Ahmad meted out the sentences after Mohd Afizi, 27, changed his plea to guilty over the two charges on Monday.
He made the decision after considering facts of the case, photographs at the scene and victims, taking into account that the victims were children who were not able to save themselves, mitigation by the defence and submission by the prosecution.
"The court gives you discount and thus, order the sentences to run concurrently," he said.
The sentences were to run from the date of arrest, which was on Jan 22.
Earlier, counsel Chris Kooi Wei Kit mitigated that his client's father was 64 years old while his mother was 50-years-old and Mohd Afizi worked as a mechanic earning RM900 salary monthly before he was detained.
Kooi said his client was a drug addict since he was 14-years-old and that he was at Saliza's house when the incident happened.
He said at that time Mohd Afizi had a quarrel with Saliza and her mother, adding that provocation factor and drug influence had caused him to commit the offence.
Meanwhile, deputy public prosecutor Norazlin Mohamad Yusoff said this was a serious offence as it involved two children aged two years old and two months old.
Norazlin said the accused failure to save the children or call Fire and Rescue Services Department after he burned down the flat unit, revealed that the accused had intention to attempt to murder the children.
She said the victims managed to go out of the unit through a window.
On Jan 29, Mohd Afizi was charged with three counts of attempting to murder Saliza, her daughter Nur Airis and her neighbour's daughter Nur Dia.
The offences under Section 307 of the Penal Code, were allegedly committed at a low-cost flat of PPR Desa Rejang in Setapak Jaya here between 1am and 1.30am on Jan 21. He later claimed trial to the charges.
However, on Feb 18, he was charged in a magistrate's court here with murdering Saliza, 29, who succumbed to severe burns on Feb 1, after 12 days in the Burns Treatment Unit of the Kuala Lumpur Hospital.
He allegedly killed Saliza in a house at the same time and place.
No plea was recorded from Mohd Afizi who faces the mandatory death sentence under Section 302 of the Penal Code, if convicted.
Magistrate Zura Syazween Hamizan fixed Apr 21 for mention pending the chemist and forensics reports.
