KOTA KINABALU: A 34-year-old man has been sentenced to 10 months' jail by the Magistrate's Court here for assaulting his wife.

Jerry Boris pleaded guilty to voluntarily causing hurt to his estranged 34-year-old wife at a house Kg Mininitod, Penampang at about 11.30am on Jan 30.


Boris was charged under Section 323 of the Penal Code Section 323 for voluntarily causing hurt, which carries a jail term of up to one year or a fine of up to RM2,000, or both, upon conviction.

Prior to sentencing, Magistrate Lovely Natasha Charles was told by prosecuting officer Insp Albert Basiri that the couple, who has four children, had been married for nine years but living separately since October 2019.


On the day of the day of the incident, the court was told that Boris was irked that his wife had gone to her relative's birthday party without his permission.

This led to an argument and scuffle. The incident was recorded by an unknown neighbour and the footage was shared on social media, Insp Basiri told the court.

Boris's wife was treated at the Queen Elizabeth Hospital for bruises on her body.

She lodged a police report over the incident and also applied for a divorce.

She was referred to the Welfare Department to obtain an interim protection order against Boris, who was arrested on Jan 31.

Prior to sentencing, Boris, who was not represented, apologised for his actions against his wife and asked for a lenient sentence.

Insp Basiri asked for a deterrent sentence to be imposed as Boris had been abusive and failed to be responsible to his family.

In the video, a man could be heard quarrelling with a woman while beating and kicking her, pulling her hair and slamming her head on the floor.

Cries, believed to be from the children, were also heard.
