Commotion Caused By Minister At KLIA, Transport Minister has not received any report

Loke said the airport authorities will conduct a detailed investigation into the commotion

Transport Minister Anthony Loke Siew Fook has not received any report regarding the incident of commotion caused by a minister at Kuala Lumpur International Airport (KLIA) Terminal 1 yesterday.

According to him, the airport authorities will conduct a detailed investigation on the commotion that occurred.

"I have not received any further report regarding the incident, I think the airport authorities will make a detailed investigation of what happened.

"Of course the safety protocol must be obeyed, whatever we leave it to the aviation authorities to do a detailed investigation," he said during the MYAirline Double Take-Off launch press conference at KLIA Terminal 2 on Friday.

On June 29, a minister who allegedly broke into the KLIA international arrivals hall to save a Chinese national was detained on entry into Malaysia.

The minister who found out about the Chinese female prisoner went to KLIA and entered the arrival hall without applying for a pass. -

LONDON: One of the world's most common artificial sweeteners is set to be declared a possible carcinogen next month by a leading global health body, according to two sources with knowledge of the process, pitting it against the food industry and regulators.

Aspartame, used in products from Coca-Cola diet sodas to Mars' Extra chewing gum and some Snapple drinks, will be listed in July as "possibly carcinogenic to humans" for the first time by the International Agency for Research on Cancer (IARC), the World Health Organization's (WHO) cancer research arm, the sources said.

The IARC ruling, finalised earlier this month after a meeting of the group's external experts, is intended to assess whether something is a potential hazard or not, based on all the published evidence.

It does not take into account how much of a product a person can safely consume. This advice for individuals comes from a separate WHO expert committee on food additives, known as JECFA (the Joint WHO and Food and Agriculture Organization's Expert Committee on Food Additives), alongside determinations from national regulators.

However, similar IARC rulings in the past for different substances have raised concerns among consumers about their use, led to lawsuits, and pressured manufacturers to recreate recipes and swap to alternatives. That has led to criticism that the IARC's assessments can be confusing to the public.

JECFA, the WHO committee on additives, is also reviewing aspartame use this year. Its meeting began at the end of June and it is due to announce its findings on the same day that the IARC makes public its decision – on July 14.

Since 1981, JECFA has said aspartame is safe to consume within accepted daily limits. For example, an adult weighing 60 kg (132 pounds) would have to drink between 12 and 36 cans of diet soda – depending on the amount of aspartame in the beverage – every day to be at risk. Its view has been widely shared by national regulators, including in the United States and Europe.

An IARC spokesperson said both the IARC and JECFA committees' findings were confidential until July, but added they were "complementary", with IARC's conclusion representing "the first fundamental step to understand carcinogenicity". The additives committee "conducts risk assessment, which determines the probability of a specific type of harm (e.g., cancer) to occur under certain conditions and levels of exposure."

However, industry and regulators fear that holding both processes at around the same time could be confusing, according to letters from U.S. and Japanese regulators seen by Reuters.

"We kindly ask both bodies to coordinate their efforts in reviewing aspartame to avoid any confusion or concerns among the public," Nozomi Tomita, an official from Japan's Ministry of Health, Labour and Welfare, wrote in a letter dated March 27 to WHO's deputy director general, Zsuzsanna Jakab.

The letter, reviewed by Reuters, also called for the conclusions of both bodies to be released on the same day, as is now happening. The Japanese mission in Geneva, where the WHO is based, did not respond to a request for comment.

DEBATE

The IARC's rulings can have huge impact. In 2015, its committee concluded that glyphosate is "probably carcinogenic". Years later, even as other bodies like the European Food Safety Authority (EFSA) contested this assessment, companies were still feeling the effects of the decision. Germany’s Bayer in 2021 lost its third appeal against U.S. court verdicts that awarded damages to customers blaming their cancers on use of its glyphosate-based weedkillers.

The IARC's decisions have also faced criticism for sparking needless alarm over hard to avoid substances or situations. It has previously put working overnight and consuming red meat into its "probably cancer-causing" class, and using mobile phones as "possibly cancer-causing", similar to aspartame.

"IARC is not a food safety body and their review of aspartame is not scientifically comprehensive and is based heavily on widely discredited research," Frances Hunt-Wood, the secretary general of the International Sweeteners Association (ISA), said.

The body, whose members include Mars Wrigley, a Coca-Cola unit and Cargill, said it had "serious concerns with the IARC review, which may mislead consumers".

Aspartame has been extensively studied for years. Last year, an observational study in France among 100,000 adults showed that people who consumed larger amounts of artificial sweeteners – including aspartame – had a slightly higher cancer risk.

It followed a study from the Ramazzini Institute in Italy in the early 2000s, which reported that some cancers in mice and rats were linked to aspartame.

However, the first study could not prove that aspartame caused the increased cancer risk, and questions have been raised about the methodology of the second study, including by EFSA, which assessed it.

Aspartame is authorised for use globally by regulators who have reviewed all the available evidence, and major food and beverage makers have for decades defended their use of the ingredient. The IARC said it had assessed 1,300 studies in its June review.

Recent recipe tweaks by soft drinks giant Pepsico demonstrate the struggle the industry has when it comes to balancing taste preferences with health concerns. Pepsico removed aspartame from sodas in 2015, bringing it back a year later, only to remove it again in 2020.

Listing aspartame as a possible carcinogen is intended to motivate more research, said the sources close to the IARC, which will help agencies, consumers and manufacturers draw firmer conclusions.

But it will also likely ignite debate once again over the IARC's role, as well as the safety of sweeteners more generally.

Last month, the WHO published guidelines advising consumers not to use non-sugar sweeteners for weight control. The guidelines caused a furore in the food industry, which argues they can be helpful for consumers wanting to reduce the amount of sugar in their diet.

KUALA LUMPUR: Banks are advised to continue offering loan repayment assistance to individuals and Small and Medium Enterprises (SMEs) in need, including assistance in scheduling and restructuring their loans.

The Prime Minister, Datuk Seri Anwar Ibrahim said, at the same time, borrowers with problems can get free advice and loan repayment assistance through the Credit Counseling and Management Agency (AKPK).

"I am satisfied with the commitment shown by banking institutions that are ready to help the people and SMEs," said Anwar who is also the Minister of Finance in a press release here today.

In addition, he also reminded the banking industry that they play an important role in driving post-pandemic economic growth, especially in helping borrowers who are still affected and are facing difficulties in continuing their lives.

The Prime Minister and Finance Minister on Wednesday (June 28), held a dialogue session with representatives of the banking sector as part of the government's ongoing efforts to obtain ideas and views related to the national economy from all walks of life.

This dialogue session was attended by the Deputy Governor of Bank Negara Malaysia (BNM), Datuk Jessica Chew, as well as bank leaders such as AMMB Holdings Bhd (AmBank), Al-Rahji Bank, Bank Islam Malaysia, CIMB Group Holdings Bhd (CIMB), HSBC Bank, Maybank , Public Bank, RHB Bank and Standard Chartered Bank.

According to Anwar, the banking industry needs to continue to support the development of micro-entrepreneurs, especially vulnerable groups through initiatives such as i-TEKAD which offers start-up capital and micro-financing by using a combination of funds from financial institutions and social finance funds such as zakat.

The representatives of the banking industry present also agreed that the focus is now on efforts to drive the transition towards a net zero carbon country as well as a wider digitization agenda.

The discussion also touched on new growth areas that can strengthen Malaysia's value proposition among regional and global investors.

"While the government is formulating the MADANI Economic Narrative, including identifying priority sectors for the country's future growth and investment, we must also ensure that the financial industry and the capital market innovate in line with the changing global landscape."

Malaysia's sovereign credit rating at "A-"

This discussion, among others, also touched on policies to ensure that the financial industry in Malaysia remains relevant and inclusive in supporting sustainable economic growth.

"However, I understand that this economic strengthening may not be fully felt by the people who are still struggling with the cost of living and also the SMEs that are recovering from the pandemic.

"Therefore, the government is determined to further enhance efforts in boosting the momentum of economic growth and implementing fiscal consolidation to ensure the well-being of the people and the continuity of business in line with the concept of CIVIL Malaysia," he added.

Meanwhile, this dialogue session is the third such session held with the Prime Minister.

Previously, Anwar had held meetings with business leaders and economic experts.

All shared views will be used to form the MADANI Economic Narrative which is being drafted to chart the direction of the country's economy in the medium and long term, and will be launched in August this year.

Economic policies and priorities under the Unity Government will also be further elaborated in the Industrial Master Plan (August 2023), the Half-Term Review of the 12th Malaysia Plan (September 2023) and Budget 2024 (October 2023).

The accused was charged in the Ipoh Magistrate's Court on Friday for killing his girlfriend at a shop in Taman Song Choon, Ipoh, last week.

IPOH: A shop assistant was charged in the Ipoh Magistrate's Court on Friday for murdering his girlfriend at a shop in Taman Song Choon last week.

Accused Saini Irwandy Sofian Sani, 23, nodded in understanding when the charges against him were read before Magistrate Jesseca Daimis.

However, no confession was recorded because it involved a murder case which is the jurisdiction of the High Court.

According to the charges, the man is alleged to have intentionally committed murder by causing the death of Shahwani Abdullah, 24.

He allegedly committed the act on the 1st floor of a shophouse in Taman Song Choon, Ipoh between 5pm Saturday and 4.54am last Sunday.

He was charged under Section 302 of the Penal Code which provides for the death penalty, if convicted.

The court then set next August 30 as the date for re-mentioning the case while waiting for the chemical report and the appointment of a lawyer.

The prosecution was handled by Deputy Public Prosecutor N. M Moganaraj Mithra while the accused was not represented by a lawyer.

Last Sunday, the media reported that a woman died believed to be beaten by her boyfriend in a fight at a shop in Taman Song Choon.

Ipoh District Police Chief, Assistant Commissioner Yahaya Hassan said, preliminary investigations at the scene found a 24-year-old woman lying unconscious on the bed.

According to him, a urine screening test against the suspect found that the victim's boyfriend was positive for the drug Methamphetamine.

Research shows how smugglers 'help' Indonesian migrant workers return home

This form of return migration, which we call 'return smuggling', is a longstanding issue between Indonesia and Malaysia. - Astro AWANI/Filepic

THE United Nations defines people smuggling as enabling foreigners into a country where they do not have the right to remain. But our research shows how Indonesian migrants in Malaysia also use smugglers to return home.

These tend to be migrant workers who do not have proper documents or lack legal residence status. For them, there often are no cheap and fast options to return legally to Indonesia. This form of return migration, which we call “return smuggling”, is a longstanding issue between Indonesia and Malaysia.

To examine this phenomenon more closely, we analysed 13 court verdicts and conducted interviews with law enforcement officials and activists from Indonesia.

We have found the smugglers respond to the demand of migrants to return home fast whenever need be. But as a consequence, smugglers face heavy penalties of at least five years in prison when sentenced under Indonesian law.

Under Indonesian law, “smuggler” is a broadly defined category. It can include the captain and his crew who pick up returning migrant workers from the beach in Malaysia. But it is also used to criminalise drivers who transport the migrants from the landing site in Indonesia to their next stop.

Meanwhile, the returning migrants are usually treated as “victims of people smuggling” and witnesses in criminal proceedings against their “smugglers”. They do not face prosecution. Even though they hired the services of smugglers to circumnavigate the migration controls of both Malaysia and Indonesia in the first place.

We found there was quite a lot of sympathy among Indonesian law enforcement staff for the smuggled return migrants. Police officers were fully aware those Indonesian migrants could not leave Malaysia through an immigration check point, as they had no passport.

Not all Indonesian labour migrants have initially entered Malaysia illegally. Many use regular migration channels. But because regular migration to Malaysia is very costly, migrants tend to overstay their permits to recuperate their investments.

But those who have lost their valid migration documents or overstayed their visa face criminal punishment under Malaysian law. This could include fines, imprisonment and caning.

The Malaysian government sometimes offers amnesty programs to overstaying migrant workers, but these are only launched infrequently. These programs also have a reputation for being slow and resulting in “blacklisting”, which means Indonesian labour migrants are not allowed to come back to Malaysia in the future.

More worrying are the high numbers of Indonesian deaths in Malaysian detention, where they are kept before being sent home.

The World Bank estimates there are around 2 million irregular Indonesian labour migrants in Malaysia, which, we argue, makes the demand for return smugglers very high.

At the start of the COVID-19 pandemic, even more migrant workers without passports may have turned to smugglers, as they needed to return to Indonesia quickly. Many of them did not have enough time to arrange lawful returns involving government agencies.

Within the first few months of the pandemic, the Indonesian government detected 427 returning migrants.

Our research shows that from 2015 to 2020, the Batam District Court in the Riau Islands recorded prosecuted “smugglers” involved in 13 cases. The actual number is likely to be much higher because smugglers and returning migrants seek to avoid authorities.

During a bilateral meeting in Jakarta in January 2023, Indonesian President Joko “Jokowi” Widodo and Malaysian Prime Minister Anwar Ibrahim discussed a number of pressing issues, including the ongoing need for more protection for Indonesian migrants in Malaysia.

The high-level meeting showed there was political concern about “safe and orderly” migration on both sides of the border.

The main attention focused on how to encourage regular migration to Malaysia, which is understood as holding a complete set of migration documents and crossing international borders through immigration check points.

The key assumption here is this type of migration means migrant workers will then have access to legal employment rights and law enforcement mechanisms. These have become a cornerstone of their bilateral effort to protect migrant workers. It is also important, to apply the “safe and orderly” migration for travel in both directions.

If the governments were to promote safe migration based on the protection needs of returning migrants, a solution would be to provide even irregular migrant workers with access to legal options for quick and affordable return options.

Since 2006, the Indonesian embassy in Kuala Lumpur has substantially improved access to its services, such as passport renewal.

However, those in need for new papers have to travel to the embassy in Kuala Lumpur and spend a lot of time to obtain these documents. If pressed for time, migrants are unlikely to pursue this option, turning instead to “smugglers” to return home quickly.

Unless Indonesia and Malaysia address this problem, return smuggling and the imprisonment of those who facilitate the return of Indonesian migrant workers will continue.

Badal haji: Mangsa penipuan dinasihat lapor polis

-Sinar Harian

KUALA LUMPUR: The wearing of face masks will no longer be compulsory on public transport and in hospitals effective July 5, said Health Minister Dr Zaliha Mustafa.

She said under the revised COVID-19 standard operating procedure (SOP), only COVID-19 positive individuals and those handling them are required to wear face masks in healthcare facilities.

She said the quarantine period for COVID-19 positive individuals would be cut from seven to five days from the onset of symptoms, also effective July 5.

"High-risk individuals like senior citizens, those with chronic diseases, individuals with low immunity or pregnant women are encouraged to wear face masks, especially in crowded places and areas with poor ventilation," she said in a statement today.

She said individuals with respiratory symptoms are also encouraged to mask up to avoid spreading infections on public transport.

Dr Zaliha said the isolation period for COVID-19 patients would be shortened because studies showed that infectivity is high in the first five days from onset of symptoms, when the viral load is high.

She also said although the COVID-19 situation was not at a worrying level and health services were not under pressure, the ministry had decided to extend the status of local infection areas in Malaysia, due to end tomorrow, by another six months until Dec 31, 2023.

This is to facilitate management of the disease as there are risks of emergence of new variants and sub-variants of SARS-CoV-2 in the country.

"Apart from this, mass gatherings are expected to occur during the Hari Raya Aidiladha celebration and also (coming) state elections, which risk contributing to an increase in cases and burdening the government healthcare service system if prevention and control measures are not fully implemented.

"It is to enable the enforcement of several provisions under the Prevention and Control of Infectious Diseases (Measures within the Infected Local Areas) (National Recovery Plan) (Transition to Endemic Phase) Regulations 2022, formulated on the powers of the Minister under subsection 11(2) of the Prevention and Control of Infectious Diseases Act 1988 (Act 342)," she said.

Dr Zaliha said new COVID-19 cases had declined by 53.5 per cent (5,801 cases to 2,698 cases) and deaths dropped by 35.3 per cent (17 cases to 11 cases) in the past five weeks, from Epidemiological Week (ME) 21/2023 to ME 25/2023.

"In terms of hospital capacity, admissions of COVID-19 patients to public hospitals and bed occupancies have dropped while usage of Intensive Care Unit beds remains stable at six per cent in ME 25/2023 compared to ME 24/2023," she said.

She also said 16,337,744 people or 50 per cent of the country's population had received the first booster dose while only 825,275 (2.5 per cent) had been injected with the second booster as at June 27 this year.

Dr Zaliha stressed that the Health Ministry would continue to monitor the COVID-19 situation and reported variants so that immediate and suitable measures could be taken when necessary.

On May 5 this year, the World Health Organisation declared that COVID-19 was no longer a Public Health Emergency of International Concern (PHEIC).

Kedua-dua kes disiasat mengikut Seksyen 39B Akta Dadah Berbahaya 1952.

KUALA LUMPUR: Two policemen attached to Bukit Aman are among four individuals charged in the Sessions Court, here today, for robbing a man of millions of ringgit at a condominium unit.

The two sergeants, namely Ahmad Shahrizan Ab Rahman, 42, from the Intelligence, Operations, Records (D4) Division and Mohamad Shawal Chekman, 40, from the Special Branch (E9) as well as Khairul Anwar Ahmad, 40, and Muhammad Firdaus Zainal, 27, pleaded not guilty before Judge Siti Aminah Ghazali.

The four men were charged with committing gang robbery on Mohammad Syafiq Hazane Dzulfikri, 25, at the Irama Wangsa Condominium, in Section 10, Wangsa Maju, at 8.30 pm on May 25.

The charges framed under Section 395 of the Penal Code provides for a prison sentence of up to 20 years and whipping, if convicted.

Deputy Public Prosecutor Nidzuwan Abd Latip said the prosecution did not offer bail as the offence was non-bailable.

"If the court allows bail, then I propose each accused is offered a bail of RM50,000 in one surety as the offence involves a robbery involving millions of ringgit," said Nidzuwan.

Lawyer Mohamed Yazzer Azzad Zainudin, representing the two policemen, asked the court to impose a lower bail for both of his clients.

"The first accused, Ahmad Shahrizan is a D4 policeman attached to Bukit Aman. He is divorced and is supporting four children. He has served with the Royal Malaysia Police for 16 years and draws an income of RM3,000 a month.

"My client also received excellent service awards in 2009 and 2018," he said.

Mohamed Yazzer said Mohammad Shawal, serving in the Special Branch (E9), is supporting four children and has received an excellent service award in 2021.

Meanwhile, lawyer Mohamad Rohan Mohamad Razi, representing two other accused asked the court for a bail of RM3,000.

The court allowed each accused bail at RM12,000 in one surety and fixed July 31 for mention.

FORMER U.S. President Donald Trump on Tuesday sued E. Jean Carroll for defamation, alleging she falsely accused him of rape after a jury in a civil trial found that he sexually abused her.

Trump's counterclaim against Carroll in Manhattan federal court comes after a jury's unusual finding in May that he sexually abused and defamed but did not rape Carroll, a former Elle magazine advice columnist.

Trump seeks a retraction as well as unspecified compensatory and punitive damages.

Carroll's lawyer, Roberta Kaplan, said in a statement that Trump's filing was "nothing more than his latest effort to delay accountability" for the jury's verdict.

"Donald Trump again argues, contrary to both logic and fact, that he was exonerated by a jury that found that he sexually abused E. Jean Carroll," Kaplan said.

Trump's lawyers did not immediately respond to requests for comment.

The filing by Trump signals that his multi-front legal fight with Carroll is unlikely to end soon as both sides trade accusations and denials in the media.

Carroll amended the first of her two lawsuits against Trump and sought an additional $10 million in damages in May, citing his denials during a CNN appearance the day after the verdict.

Trump's filing in that same lawsuit Tuesday cite Carroll's statements on CNN after the verdict, when she said Trump raped her despite the jury's finding that he only sexually abused her.

Trump, who is running to retake the White House in 2024 and has a comfortable lead over his Republican rivals, has denied raping Carroll. He is appealing the verdict, which found he must pay $5 million in damages.

Carroll testified that Trump raped her in a New York City department store in the mid-1990s and then ruined her reputation by calling her a liar when she went public in 2019.

The new filings come in Carroll’s first lawsuit against Trump, which she filed in 2019 for defamation only. The case has been bogged down in appeals over whether Trump was immune from being sued because he had been president when he spoke.

Carroll filed her second lawsuit against Trump for both defamation and sexual assault after New York passed a law giving survivors of sexual violence a window to file civil suits even if the statute of limitations on their claims had passed.

PARIS: A French police officer is being investigated for homicide after shooting dead a 17-year-old on Tuesday morning in the Paris suburb of Nanterre after the youth failed to comply with an order to stop his car, the local prosecutor's office said.

BFM TV broadcast images of sporadic clashes breaking out between youths and police on Tuesday evening, as anger over the death of the teenager grew in the local community.

The officer fired at the boy, who subsequently died from his wounds, said the Nanterre prosecutor's office.

A video shared on social media, verified by Reuters, shows two police officers beside the car, a Mercedes AMG, with one shooting as the driver pulled away.

After a record 13 deaths from police shootings in France during traffic stops last year, this is the second fatal shooting in such circumstances in 2023.

Three people were killed by police shooting after refusing to comply with a traffic stop in 2021 and two in 2020. A Reuters tally of fatal shootings in 2021 and 2022 shows the majority of victims were Black or of Arabic origin.

"As a mother from Nanterre, I have a feeling of insecurity for our children," said Mornia Labssi, a local resident and anti-racism campaigner, who said she had spoken to the victim's family, which she said was of Algerian origin.

One passenger was taken into police custody but later released while police were unable to contact another passenger, the prospector's office said. The driver was "known to the judicial services for having refused to comply with a traffic stop" on a previous occasion, it said.

Paris police chief Laurent Nunez told BFM TV that "this act raises questions for me" and that the justice system would decide whether or not it was appropriate.

Interior Minister Gerald Darmanin said in a Twitter post that the General Inspectorate of the National Police was investigating "to shed light on the circumstances of this drama."

Seafield temple riot: 17 men acquitted, discharged

Seafield temple riot: 17 men acquitted, discharged

27-06- 2023 05:20 PM

PETALING JAYA: The Magistrate’s Court here today acquitted and discharged 17 men who were accused of rioting at the Seafield Sri Maha Mariamman Temple in Subang Jaya five years ago, without calling for their defence.

Magistrate Muhammad Iskandar Zainol made the decision after the prosecution had failed to establish a prima facie case against the group at the end of the prosecution’s case.

In his ruling, Muhammad Iskandar said the court found that witnesses in the case had failed to identify the accused persons involved in the case and the witnesses’ statements in the court were inconsistent.

“The prosecution also did not tender any weapon in court as an exhibit such as a knife as stated in the charge sheet.

“All the weapons were merely collected from the scene by the witnesses and not seized from the accused persons,” he said.

The 17 who were acquitted are Saifullah Abdullah, Muhammad Riduan Sekh Ruslan, Irwan Noordin, Mohamad Khairi Abdul Rashid, Rozaihan Zakaria, Muhammad Qayyum Mohd Faisal, Mohd Ashraf Mohd Faizal, Absal Eastrie Abdullah, Mohamed Jalil Talib, Muhammad Khairol Anuar Zabidi, Mohd Zamri Md Said, Shukri Razali, Nor Azmi Abdul Ghani, Mohammad Shahril Danniel Sajeel, Muhammad Hasneezam Shah Samsudin, Akmal Izzat Azi and Mohd Norul Ismawi Islahuddin.

The men, aged between 24 and 47, were charged with rioting and possessing dangerous weapons between 2 am and 5 am on Nov 26, 2018.

They were charged under Section 148 of the Penal Code, which carries a maximum penalty of five years imprisonment, a fine, or both, upon conviction.-Bernama

Apex court affirms decision declaring amended pension law null and void

The Federal Court here today affirmed the Court of Appeal's decision that declared the amended pension law as null and void. - PEXELS

PUTRAJAYA: The Federal Court here today affirmed the Court of Appeal's decision that declared the amended pension law as null and void.

The five-member bench led by Court of Appeal President Tan Sri Abang Iskandar Abang Hashim unanimously dismissed the appeal by the Malaysian Government and Public Service Department (PSD) director-general to overturn the appellate court's decision.

The others on the bench were Chief Judge of Malaya Datuk Mohamad Zabidin Mohd Diah, Chief Judge of Sabah and Sarawak Tan Sri Abdul Rahman Sebli, and Federal Court judges Datuk Seri Hasnah Mohamed Hashim, Datuk Rhodzariah Bujang.

In delivering the court's decision, Justice Mohamad Zabidin said Section 3 and Section 7 of the Pensions Adjustment (Amendment) Act 2013 (PAA), which allows a two per cent increment annually, were less favourable to pensioners and thus contravened Article 147 of the Federal Constitution (which provide for the protection of pension rights).

"It is our unanimous decision that there is no merit in the appellants' (the government and PSD director-general) appeal. The appeal is therefore dismissed and the decision and order of the Court of Appeal is affirmed," he said.

Justice Mohamad Zabidin also said both the High Court and Court of Appeal have observed that the amended Section 3 (2) of the PAA was in fact an acknowledgement that the amendments could result in a less favourable situation.

Justice Mohamad Zabidin said the appellate court was right to point out that the less favourable situation may never be rectified as the mechanism provided under the amended section 3 (2) of the PAA to address a less favourable situation should it arise, was merely 'permissive" and imposes no obligation to act.

The amended Section 3 (2) of the PAA states that where the application of a specified rate of increment would result in a situation that is less favourable to an officer appointed before the coming into force of the amendment, the Yang di-Pertuan Agong may by order in the gazette prescribe an appropriate higher percentage of increment to be applied in such cases.

Justice Mohamad Zabidin also said that the Court of Appeal was correct to restore the status quo prior to amendments to the Act because when the court strikes down the statute or amendment to the statute, the pre-existing provision is automatically revived.

On Jan 13 last year, the Court of Appeal declared the amended Section 3 and Section 7 which came into effect from Jan 1, 2013, were null and void as they contravened Article 147 of the Federal Constitution.

Aminah Ahmad, who retired as a civil servant with the Ministry of Foreign Affairs, sued the Malaysian Government and the PSD director-general in her personal capacity and on behalf of 56 retired members of the public services, claiming that the amendments to the PAA in 2013 resulted in a situation "less favourable" to her as compared with the preceding retirement adjustment Scheme under the Pensions Adjustment Act 1980.

Under the old scheme, the retiree's pension is revised based on the prevailing salary of incumbent civil servants in that grade. However, the 2013 amendment was introduced based on a flat rate of two per cent annual increment.

Aminah initially lost her case at the High Court in 2020. She then appealed to the Court of Appeal which decided in her favour. The government and the PSD director-general obtained leave to appeal last year.

Senior federal counsel Shamsul Bolhassan, Liew Horng Bin and Federal counsel M. Kogilambigai appeared for the Malaysian Government and PSD director-general while lawyers Datuk Lim Choon Khim, Chin Yan Leng and David Yii Kee Kiet represented Aminah.

LOS ANGELES/GLASTONBURY: Call it Beyflation. Or maybe Swiftflation.

The cost of certain goods is retreating in some places, but that doesn't include live music. Concert tickets have surged in price, to the point where economists are noticing.

Fans are shelling out a fortune for tickets to see the world's biggest music acts, including names like Taylor Swift and Bruce Springsteen who haven't toured for years. And while few doubt the star power of Beyoncé live, until now people weren't factoring her into national inflation figures.

"People are willing to splurge because they know they will get quality content, plus who knows when or if she'll do another tour after this one," said London-based Beyoncé fan Mario Ihieme.

The United Kingdom's recreation and culture prices rose 6.8% in the year to May 2023, their fastest in 30 years, with the largest effect from cultural services, "particularly admission fees to live music events".

Event prices in UK inflation data are based on when shows take place, not when tickets are bought. But with different artists performing every month, it's hard to compare one to the other, an Office for National Statistics spokesperson said.

"The (subjective) quality of music artists emphasises how difficult it is to calculate a 'clean' price increase," said UBS Global Wealth Management chief economist Paul Donovan. "And for UK inflation, the pressures may persist," he added, noting a string of UK gigs by singer Harry Styles in June.

A perusal of ticket-purchasing sites makes the sticker shock clear. On reseller Stubhub, the cheapest seat for a July Taylor Swift show in Seattle is $1,200; tickets for an August Mexico City show cost $500 each.

"I had to get nine phone numbers for three different accounts on Ticketmaster under three different credit cards," said Joel Barrios, a Beyoncé fan in Los Angeles. He spent about $7,000 on three U.S. shows for himself and friends - as well as another $6,650 for several shows in Europe.

Others say they had an easier time. Carolina Candelas spent 92 euros ($101) each to see Beyoncé with her sisters and parents in Barcelona. "My sister purchased them in a presale link that Ticketmaster sent her, so I think it was really easy," she said.

But with live music just a subset of overall entertainment costs, which account for a smaller part of consumer spending than housing or food, some questioned the idea that concert prices could have an appreciable effect on inflation.

Andy Gensler, executive editor of Pollstar, a publication that tracks the global concert industry, called it a "ridiculous assertion" that Beyoncé's shows would affect inflation. While ticket prices have increased, he said, mid-year figures haven't shown an appreciable rise since May 2022, when U.S. inflation was 8.6%.

With demand far exceeding supply, TD Cowen vice president of equity research Stephen Glagola said prices for tickets on the secondary market had soared to an average 75% to 100% above face value.

The U.S. Labor Department does not specifically measure inflation for concert prices, but the inflation rate for live performing admission events is currently 2.6 percentage points more than U.S. headline inflation. That gap has increased this year as headline figures have declined.

COME TOGETHER

Across Asia, crowds are flocking to see marquee names like Bruno Mars, Coldplay and the Backstreet Boys.

"Had it not been for the gig, I wouldn't have travelled," said Fairuz Zahari, 36, from Malaysia, who has visited numerous countries for concerts, most recently Ed Sheeran in Australia.

In India, fans are happy to pay a premium for quality entertainment, according to Owen Roncon, chief of business for Live Entertainment at BookMyShow.

"The average ticket price for Backstreet Boys DNA World Tour - India, was between 7,000-8,000 rupees ($85-$98) - which is a very healthy growth," he said, referring to the concert in May.

A recent survey from U.S. event management company Eventbrite showed 80% of consumers want to go out as much or more this year, even as fans endure the cost and difficulty of securing tickets to big events.

Live Nation Entertainment LYV.N CEO Michael Rapino said last month that ticket sales had risen 41% in the first quarter, with prices up by double digits.

In Britain, about 150,000 music fans paid 340 pounds ($431)for a ticket to June's Glastonbury festival to see Elton John and hundreds of other acts.

Beth Cook, a social media director from Leeds in northern England, said she expected to spend 100 pounds a day at the five-day festival.

It's worth the expense, she said.

"When the pandemic was in full swing, I think everyone was in a really low mood, and we missed out on events like this, where people all come together.

"Now I think with things up and running, the people who can afford to are saving up to come to things like this because they are amazing."
