PETALING JAYA: The Sessions Court here today acquitted and discharged celebrity preacher, Da'i Syed, or whose real name is Syed Shah Iqmal Syed Mohammad Shaiful, on two charges of committing unnatural sex and using criminal force to a private college student with intent to outrage her modesty.
Judge Jamaludin Mat made the ruling after allowing the defence's application to free Syed Shah Iqmal, 27, on both the charges.

"The accused is acquitted and discharged in accordance with Section 254 (3) of the Criminal Procedure Code for both cases and bail (of RM25,000) is returned," he said.
On Dec 10, 2020, Syed Shah Iqmal pleaded not guilty to a charge of having unnatural intercourse with the woman, then aged 22, at his rented house at Damansara Perdana here, between 3 am to 4 am on Oct 17, 2020.
He was charged under Section 377B of the Penal Code which provides an imprisonment for up to 20 years as well as whipping, upon conviction.
On the charge with using criminal force on the woman with intent to outrage her modesty at the same place and date, it was framed under Section 354 of the Penal Code, which provides an imprisonment for up to 10 years, or fine, or whipping, or any two of the punishments, if found guilty.
Earlier, deputy public prosecutor Norhashimah Hashim told the court that she had applied for Syed Shah Iqmal to be discharged not amounting to an acquittal (DNAA) on both the charges.
She said the application was made in accordance with Section 254 (2) of the Criminal Procedure Code.
"After examining the case, the prosecution applied for a DNAA order, as among others, the complainant in this case suffered from serious depression to an extent of injuring herself several times and making death wishes," she said. adding that the prosecution could still proceed with the case even if the complainant withdrew the police report.
"The complainant or victim did not appear in court to take her oath to testify regarding the withdrawn police report. In this case, it is the prosecution that is applying for the DNAA after taking into account the complainant's health condition," she said.
According to Norhashimah, the DNAA order will not prejudice the accused as long as he is not proven guilty and there was no need for him to feel burdened, being that he has been released on bail by the court previously.
Lawyer Syed Amirul Syed Edros, representing Syed Shah Iqmal, applied for his client to be acquitted and discharged from the two charges as the defence believed the complainant did not intend to pursue the case and would only focus on the complainant's oral evidence.
"On grounds the complainant is suffering from depression and is in a bad state to testify is a shaky reason. It is apt to sympathise, but the court has fixed the dates 13 times, including for mention, but the complainant herself withdrew the report in December last year."
"This shows that the complainant is not interested in pursuing the case. The basic police report was withdrawn by the complainant voluntarily without coercion or the existence of an element of bribery," said the lawyer.
Syed Amirul said the investigation was conducted based on the complainant's police report, which led to his client to be charged in court on Dec 10, 2020.
"This means that the case has been going on for 538 days since the accused was charged, but today the prosecution informed that it does not intend to continue the case.
"In this regard, the defence is seeking a 'decision' from the court to prevent the case from continuing to be on hold and Syed Shah Iqmal can be charged at any time," he said.

KATHMANDU, Nepal -- Rescuers searching a mountainside in Nepal on Monday recovered the bodies of 21 of the 22 people who were on board a plane that crashed a day earlier, officials said.
The search is continuing for the remaining person, Kathmandu airport spokesman Tek Nath Sitaula said.
Recovery efforts were delayed because some bodies were pinned under the plane's wreckage. Rescuers working with their bare hands had difficulty moving the metal debris.
Aerial photos of the crash site showed aircraft parts scattered on rocks and moss on the side of a mountain gorge.
The Tara Air turboprop Twin Otter lost contact with the airport tower on Sunday while flying on a scheduled 20-minute flight in an area of deep river gorges and mountaintops.
Relatives waited most of the day at the airport for news of their loved ones.
Four Indians and two Germans were on the plane, Tara Air said. The three crew members and other passengers were Nepali nationals, it said.
German news agency dpa reported that the two Germans were a man and a woman from the western state of Hesse.
"Unfortunately, we have to assume at this point that the two people are no longer alive," dpa quoted a spokesperson for the Hesse state interior ministry as saying. "On the part of the Hessian police, relatives have already been informed and care measures initiated."
Local news reports said the passengers included two Nepali families, one with four members and the other with seven.
The army said the plane crashed in Sanosware in Mustang district close to the mountain town of Jomsom, where it was heading after taking off from the resort town of Pokhara, 200 kilometers (125 miles) west of Kathmandu.
According to tracking data from flightradar24.com, the 43-year-old aircraft took off from Pokhara at 9:55 a.m. and transmitted its last signal at 10:07 a.m. at an altitude of 12,825 feet (3,900 meters).
The plane's destination is popular with foreign hikers who trek on its mountain trails, and with Indian and Nepalese pilgrims who visit the revered Muktinath temple.
The wreckage was located by villagers who had been searching in the area for the Yarsagumba fungus, which is commonly referred to as Himalayan Viagra, according to local news reports.
The Setopati new website quoted a villager, Bishal Magar, as saying that they heard about the missing plane on Sunday but were only able to reach the site on Monday morning after following the smell of fuel.
Magar said it appeared the plane may have clipped the top of a smaller mountain and then slammed into a bigger mountain.
The Twin Otter, a rugged plane originally built by Canadian aircraft manufacturer De Havilland, has been in service in Nepal for about 50 years, during which it has been involved in about 21 accidents, according to aviationnepal.com.
The plane, with its top-mounted wing and fixed landing gear, is prized for its durability and its ability to take off and land on short runways.
Production of the planes originally ended in the 1980s. Another Canadian company, Viking Air, brought the model back into production in 2010.

JOHOR BAHRU: A local man who was believed to be involved in a drug trafficking syndicate died, believed murdered over a dispute with syndicate members at an apartment in Jalan Masai Jaya 2 here yesterday.
Johor police chief Datuk Kamarul Zaman Mamat said in the incident at 12.45 am at a unit on level two, the 23-year-old victim was found dead on the ground floor believed to have fallen from the balcony.

According to him, a fight was believed to have broken out on the second floor of the building between the victim and three local men who were also syndicate members aged between 20 to 30 which led to the death.
"Police received information from the public that the victim fell from the second floor balcony and died.
"They were partners of a drug syndicate and one of them probably did not pay up his drug debt which led to the fight," he told a media conference here today.
He said a forensic unit investigation found signs of a struggle as well as criminal element which caused the victims to fall from the balcony.
Kamarul Zaman said police would be looking into whether the man was pushed from the balcony.
Following investigations, three individuals were picked up on the same day in Desa Jaya here.
A background check showed the three individuals have past records relating to crimes and drugs and were remanded for seven days from today (May 30) and they would be investigated under Section 302 of the Penal Code.
In another development, a 40-year-old private sector employee in the state became the latest victim of 'Love Scam' and lost almost RM500,000 after being duped by a man on social media.
He said the single woman made 20 transactions from last year to yesterday to the man who is a foreigner before realising she had been cheated and lodged a police report.
"She was told to put her money into 15 different accounts in the scam," he said.

SHAH ALAM: The Selangor police detained an 'Instafamous' individual yesterday to assist investigations regarding a dance show featuring a man scantily dressed as a woman and a fireworks show at I-City here last Friday.
Shah Alam district police chief ACP Mohd Iqbal Ibrahim said the event organiser, known only as 'Cik Lala' has been detained and remanded until May 31 after several recordings of the event were uploaded on the Tik Tok social media platform.

He said preliminary investigations revealed that the incident took place from around 8 pm until 11.30 pm at Centralwalk I-City, here on May 27.
"The complainant is the I-Soho I-City joint management body (JMB) manager, who lodged the report on May 28 after receiving a WhatsApp message about a half-naked dance that tarnished I-City's image as a tourist attraction in Selangor.
"The activity was accompanied by loud music and a fireworks show in a public area near residents' homes. Cik Lala was the individual who rented the unit for RM4,000 for a Hari Raya celebration with about 50 of her guests," he said in a statement today.
Cik Lala will be investigated under Section 509 of the Penal Code, Section 6 of the Explosives Act 1957 and Section 233 of the Communications and Multimedia Act 1998, he said.
"We are also in the process of making several other arrests and any new information will be updated later. Any information related to this case can be channelled to Insp Nur Syuhada at 017-6942736," he added.

KUALA LUMPUR: A golf caddy was sentenced to a month's jail and fined RM16,000 by the Magistrate's Court here today for driving recklessly and using a fake vehicle registration number.
Magistrate Fardiana Haryanti Ahmad Razali sentenced M. Yuvarajan, 32, to one month in jail and a fine of RM8,000 after he pleaded guilty to driving a white Perodua Myvi car in a reckless manner that endangered other road users.

The court ordered Yuvarajan to serve his jail term from today, in addition to being disqualified from holding or obtaining a driving licence for five years.
He was charged under Section 42 (1) of the Road Transport Act 1987 and punishable under the same law, which carries a maximum jail term of five years and a fine of not less than RM5,000 and a maximum of RM15,000, as well as disqualification from holding or obtaining a driving licence for not less than five years.
Fardiana Haryanti also imposed a fine of RM8,000 on Yuvarajan for using a fake vehicle registration number, according to Section 108 (3) (e) of the Road Transport Act 1987.
The offence is punishable under the same law, which carries a fine of not less than RM5,000 and a maximum of RM20,000 or imprisonment of not less than one year and a maximum of five years, or both, upon conviction.
He was accused to have committed both offences on the Middle Ring Road 2 (MRR2), at 5.30 pm, on May 7.
The court also ordered Yuvarajan to serve another four months in jail if he failed to pay the RM16,000 fine.
Yuvarajan, who was not represented, appealed for leniency as he was supporting his wife and a child, apart from at the time of the incident he was not under the influence of alcohol, while deputy public prosecutor Siti Nursyuhada Abd Rauf pressed for a just sentence to serve as a lesson.
A video clip lasting 27 seconds of the incident went viral on Facebook's Inforoadblock page showing a Perodua Myvi driver provoking and obstructing other drivers.

The announcement was made today in Geneva at 10 am (Geneva time).
The appointment was based on the principle of rotation between geographical regions. Malaysia is currently serving as a board member of the WHO Executive Board from 2021 to 2024.

In congratulating Khairy, Health director-general Tan Sri Dr Noor Hisham Abdullah said the appointment was unprecedented and a great honour for Malaysia.
He said Malaysia aspires to champion the priorities and vital common issues that the regional and global communities face, by being the voice as the vice-president of the World Health Assembly and now the vice-chair of WHO Executive Board.
"In the midst of every crisis lies great opportunities to do what is right for the people and communities, locally and globally. Malaysia has always been at the forefront to advance global public health," he said in a post on Facebook today.
In addition to the nation's strong leadership in safe and affordable surgery, he said, Malaysia will contribute towards the success of WHO's efforts in leading the international community in areas that include the COVID-19 response, digital health innovation, healthy and active ageing, mental health, non-communicable diseases (NCD) and climate change.
"In solidarity, we will address current issues such as International Health Regulations (IHR), vaccine inequity, health systems and all related Global Public Health preparedness and response to win the public health battle together," he added.

KUALA LUMPUR: A resident of Rumah Bonda today admitted that the burn marks suffered by a teenage girl with Down syndrome known as Bella were due to hot water from a thermos flask and not from a water dispenser.
Yasmin Nahar Mahmood, 19, agreed with lawyer Nurul Hafidzah Hassan's suggestion that Bella was playing with the flask in the laundry room of a condominium in Wangsa Maju before the water in the flask spilt on her.

Nurul Hafidzah is representing Rumah Bonda founder Siti Bainun Ahd Razali who is charged with two counts of neglecting and abusing the teenage girl, causing the victim to suffer physical and emotional injuries.
The offences were allegedly committed at a condominium in Wangsa Maju, here, between February and June 2021, under Section 31(1)(a) of the Child Act 2001 which carries a jail sentence of up to 20 years or a fine of RM50,000 or both, upon conviction.
Testifying before the Sessions Court Judge Izralizam Sanusi, the fifth prosecution witness also agreed with Nurul Hafidzah's suggestion that she had told the police the same thing (regarding the thermos flask) at the condominium lobby on July 7, 2021.
Previously, Yasmin told the court that Siti Bainun ordered her to splash hot water from the water dispenser on Bella three times a week using a yellow plastic cup without a handle and a syringe.
Asked by the lawyer about the cause of the water spill from the flask was due to a scuffle between Bella and another resident known as Balqis after the former finished Balqis' face wash and snacks, the witness said she was not sure.
Yasmin, however, did not agree with the suggestion made by another of Siti Bainun's lawyer, Nur A'minahtul Mardiah Md Nor, that no water dispensers or water heaters were confiscated as the police officer who came to the condominium only took the thermos flask.
Yasmin also disagreed with Nur A'minahtul's suggestion that she was the one who tied Bella and refused to give the girl water to drink which was witnessed by a resident named Siti.
She also disagreed with the lawyer's suggestion that her testimony to the court was fabricated and aimed at putting Siti Bainun behind bars.
Asked by Deputy Public Prosecutor Zahida Zakaria about the piece of cloth allegedly stuffed in Bella's mouth by Siti Bainun, the witness said she did not tell the police about the matter after Siti Bainun instructed her not to do so.
"If I told the police, I would be scolded, I don't trust anyone, the cloth smell...it was thrown away," said the witness.
The trial continues tomorrow.

KUALA LUMPUR: The public has been advised not to panic on seeing Royal Malaysian Air Force (RMAF) aircraft flying at low altitude over certain areas in the Klang Valley.
In a statement today, RMAF said its aircraft would be conducting rehearsals for the RMAF 64th anniversary parade to be held on Wednesday at the Subang Air Base.

"During the exercise, RMAF aircraft will perform low-level and tactical flights as rehearsal for capability demonstration," it said.
The RMAF has been making preparations for the parade, which includes a fly-past by RMAF aircraft.

The Pandan division chief thanked party members for electing him to the number two post of the 23-year-old party.
"In the history of PKR elections, never before has a candidate for the deputy president's post secured such a big mandate, getting almost 60 per cent of the popular vote with more than 80 per cent of all divisions throughout the country supporting me.
"I know it's not because PKR grassroots members like me more than Datuk Seri Saifuddin Nasution Ismail. I know I am just an ordinary member without any post and has many weaknesses," he said in a post on his Facebook today.
Rafizi, who was an appointed vice-president before this, said the grassroots gave a strong mandate to an ordinary member because they wanted PKR to return to the path of reform on which the party was built.
The former Pandan Member of Parliament urged party leaders at all levels to graciously accept the decisions made by the grassroots through the ballot boxes.
According to unofficial results displayed on the 2022 PKR Election website, Rafizi garnered 68,451 votes while Saifuddin collected 48,223 votes in the contest for the deputy president's post.
However, the official results will only be announced at the annual PKR national congress on June 25.
In SEREMBAN, Negeri Sembilan PKR chief Datuk Seri Aminuddin Harun said the new leadership could strengthen the party for facing GE15.
Speaking to reporters at a Petronas Aidilfitri open house, he thanked PKR members for voting in the party election and his supporters for electing him as a vice-president.

MELAKA: Kumpulan Karangkraf (Karangkraf) has been named as the 2022 National Journalists Day (HAWANA 2022) Award recipient today.
After a two-year hiatus due to the COVID-19 pandemic, the HAWANA 2022 main event saw Karangkraf, a media organisation of over 40 years, bag the prestigious award, along with a trophy, certificate and RM10,000 in cash.
Prime Minister, Datuk Seri Ismail Sabri Yaakob, presented the award to Karangkraf chairman, Datuk Dr Hussamuddin Yaacub.
The recipient was selected based on several criteria, including being registered and producing excellent work of quality, in-depth analysis of issues, and impactful in the year of assessment.
The recipient must also practice good governance and journalistic values, contribute to the development of journalism and the media industry in the country, and their work must bring about human development, peace and prosperity.
Kumpulan Karangkraf made its first appearance in 1978, with the publication of Mingguan Kanak-kanak, and in 1990, expanded its business scope by the publication of books of several genres, through Alaf 21 and Karya Bestari.
In 2006, the group published the regional tabloid, Sinar Harian, that went down in history as the fastest growing newspaper in Malaysia.
The media group now stands tall in the industry with 13 magazines, novel publication, printing, Internet media channels and news reporting.
In 2015, the group started the 'Malaysia Ngaji' programme, followed by the World #QuranHour campaign in 2016 and several spinoffs, including Malaysia #QuranHour, Merdeka #QuranHour and World #QuranConvention, that had a cumulative participation of around 2.475 billion.
In February 2021, the group introduced an aggressive anti-corruption initiative known as #RasuahBusters, involving media groups, individuals, organisations and private companies, and it currently has 550 strategic partners.
The HAWANA 2022 Award aims to acknowledge and honour professional journalists, individuals or organisations, that have contributed significantly, not only in the field of journalism but also in shaping the minds of Malaysians through published works.
May 29 has been gazetted as National Journalists Day, in conjunction with the publication of the first newspaper in Malaysia, Utusan Melayu, on May 29, 1939, which became the first media platform in the country.
The first time HAWANA was held was on April 11 2018 at Matrade Exhibition and Convention Centre in Kuala Lumpur. The inaugural celebration, themed 'Defending the Nation, Building the Country', was attended by about 1,000 media practitioners from all over the country.
On Nov 30, 2021, the government decided to retain the date May 29 annually as National Journalists Day.

KUALA LUMPUR: Two local celebrities, Hans Isaac and Syed Ahmad Abdul Rahman Alhadad, popularly known as Altimet, failed in their first attempt to break into the country’s political arena as the unofficial results of the PKR election were released today.
According to the official website of the elections, the artistes who competed for the Ampang division chief post only managed to get 609 and 589 votes respectively, thus losing to Daing Muhammad Reduan Bachok who obtained 942 votes.
The election also threw a surprise result when PKR information chief Datuk Seri Shamsul Iskandar Mohd Akin (379 votes) lost to Mohd Rafee Ibrahim (488 votes) for the Hang Tuah Jaya division chief post.
Sungai Petani Member of Parliament (MP) Datuk Johari Abdul once again failed to secure the Sungai Petani division chief position when he lost to Ooi Tze Min by 103 votes.
Meanwhile, Rafizi Ramli, who is also the party’s deputy president candidate, managed to defend his position as Pandan division chief by garnering 548 votes, defeating Mohamad Rashidi Hassan (373) and Adnan Jaaffar (121).
Selangor Menteri Besar Datuk Seri Amirudin Shari garnered 1,858 votes to defend his post as Gombak division chief, defeating Farhash Wafa Salvador Rizal Mubarak (former political secretary to PKR President Datuk Seri Anwar Ibrahim) who managed to secure 1,215 votes.
In Negeri Sembilan, Menteri Besar Datuk Seri Aminuddin Harun, who made his debut in contesting for the party’s Port Dickson division chief post obtained 1,129 votes to defeat Ravi Munusamy (951) and Sevalingam Birasami (477).
He has held the position of Tampin division chief since 2018 and Seremban division deputy chief before that.
Meanwhile, Simpang Renggam MP Maszlee Malik’s first attempt to contest for PKR’s Simpang Renggam division chief post was rewarded when he won after obtaining 109 votes, defeating Faizul Abdul Ghani (66 votes).
As of 5 pm today, seven states had announced the election results namely Kedah, Selangor, Negeri Sembilan, Melaka, Kelantan, Sabah and Johor. - Bernama

Therefore, Ismail Sabri said silat practitioners should be in a state of readiness to manage its journeys in the country.

He said silat practitioners as the country's third bastion of defence could help the government maintain the peace and prosperity of the country that the Keluarga Malaysia (Malaysian Family) was currently enjoying.
"The harmony and peace must be maintained as our success also depends on the country being peaceful and well-governed.
"However, all the country's successes and achievements did not happen overnight. It is the result of the efforts of the previous generation of the Malaysian Family that should be continued by the current generation," he said when officiating the Pertubuhan Seni Silat Lincah Malaysia (PSSLM)'s Assembly and 36th Graduation Ceremony, here today.
Also present were PSSLM's Ulul Amri Datuk Seri Najib Tun Razak, PSSLM's Mahaguru Muda Datuk Megat Zulkarnain Omardin and Tan Sri Noh Omar.
The Prime Minister said silat not only taught the practitioners about martial arts but more importantly to build a society with inner resilience, identity, discipline, good character and create a society with loyalty and love for the country.
"These elements are important in the government's efforts to achieve the aspirations of the Keluarga Malaysia as outlined.
"In order to realise the role that martial arts practitioners can play in ensuring the sovereignty and prosperity of the country is safeguarded, such assembly as this can benefit everyone," he said.
Ismail Sabri said silat also needed to be safeguarded so that the culture that had been established for so long could be maintained and accepted by all levels of society.
In this regard, he called on silat organisations to expand the silat culture through various channels for public and private employees as well as institutions of higher learning as it is believed be able to produce youths with noble values.
According to him, silat plays a huge role in helping the government to prevent the country's youths from unhealthy elements by inculcating good and noble character, self-confidence, disciplined and obedience to the leaders through silat training.
"The role played by silat is huge. In terms of culture and sports, silat can introduce Malaysia's identity to the world. Silat should be institutionalised as a platform and discourse for knowledge development through strategies based on education, cultural heritage and sports agenda," he said.
Ismail Sabri said the government always supported the efforts carried out by various parties, including silat activities in generating human and intellectual capital as well as acting as the community's agent in strategic planning and implementation for positive impact programmes.
According to him, this was clearly proven when the government recognised silat as a national heritage in 2015 which was the government's first step in ensuring that silat culture did not become extinct but continued to be practised and inherited.
Apart from the recognition of silat as one of the country's official martial arts, he said the struggle of the silat world was also given recognition, for example, the struggle of the late Mahaguru Tan Sri Omardin Mauju in the country's silat.
"The title 'Pendekar Negara' awarded to the late (Omardin) has raised the image of silat. He contributed greatly to the history of modern silat in the country. It is hoped that there will be more individuals to receive recognition from the government in the world of silat," he said.
In the meantime, Ismail Sabri also announced that the government will continue the construction of the National Silat Complex in efforts to introduce silat globally.
Earlier, Ismail Sabri also received the 'Selendang Kehormat Tertinggi' which he described as one of the highest recognition and appreciation.

Tara Air's 9 NAET twin-engine aircraft, which went missing in the mountainous district of Mustang in Nepal on Sunday morning, was found at Kowang village of the district, Nepal airport officials said. According to the information given by the locals to the Nepal Army, the plane crashed at the mouth of the Lamche river under the landslide of Manapathi Himal. There is no word on survivors, and the fate of the 22 people on board, including four Indians, remains unknown
The Tara Air plane, a Canadian-made de Havilland DHC-6 Twin Otter, which was carrying 19 passengers and three crew members, took off Sunday morning from the central city of Pokhara and headed for Jomsom, a village high in the Himalayas. Air traffic controllers lost contact with the plane during the flight, which normally takes about 30 minutes.
Locals reported that the plane made two circles in Khaibang.
The 9N-AET Twin Otter carrying 22 people, including three crew members, took off from Pokhara at 9:55am for Jomsom. But it lost contact at 10:07am in the Ghodepani area, according to a statement issued by the Civil Aviation Authority of Nepal.
The plane was carrying 13 Nepalis, four Indians and two Germans.

Rafizi has won the position of PKR Deputy President

KUALA LUMPUR: The unofficial results show that former PKR vice -president Rafizi Ramli has won the PKR deputy president post in the party's election this time.
Rafizi's who is also a former Pandan Member of Parliament, obtained the highest number of votes collected at 66,359 in most branches in the states.
As of 9.30pm tonight, based on the results shared on the official PKR Election website, www.pemilihankeadilan2022.com , Rafizi has won in Selangor, Johor, Kelantan, Melaka, Kedah, Negeri Sembilan, Perak, Pahang, Terengganu, the Federal Territory and Penang.
He only failed to compete with his rival who is also PKR Secretary General, Datuk Seri Saifuddin Nasution Ismail, in Perlis and Sabah who obtained 47,986 accumulated votes.
Only Sarawak has not announced its results so far, but the number of votes in Sarawak, which is around 1,990 votes, is not expected to be able to influence the votes obtained by Rafizi.
In fact, Saifuddin Nasution through a post on his official Facebook has congratulated Rafizi on his victory.
As for the position of PKR Vice President, Setiawangsa Member of Parliament, Nik Nazmi Nik Ahmad; Tanjung Malim Member of Parliament, Chang Lih Kang; Selangor Menteri Besar, Datuk Seri Amiruddin Shaari and Negeri Sembilan Menteri Besar, Datuk Seri Aminuddin Harun are seen to have a good chance to fill the top four position for the party's number three position.
