KUALA LUMPUR: An animal activist and a non-governmental organization (NGO) today filed a legal action to obtain a court order for the Attorney-General's Department (AGC) to prosecute a man who tortured and killed baby monkeys for entertainment by selling videos of the torture. through the Telegram application.

Dr Kartini Farah Abdul Rahim, 50, and the Global Malaysia Wildlife Rights Organization (Hidup) as applicants filed an application for judicial review permission through Messrs Raj & Sach at the High Court here, naming the Royal Malaysian Police (PDRM), the AGC and the Malaysian government as first to third respondents.

Based on the documents obtained by the media, the woman applied for an order to cancel the AGC's decision dated 5 April last not to take further action on the investigation of the police report made by the applicant, in addition to applying for an order instructing the AGC to charge the individual under the appropriate law.



Dr Kartini claimed that on the 20th of January, She had received information from two animal lovers' associations from the United Kingdom and the United States about a group of monkey torturers that the individual had acted in such a way and that there were hundreds of members who joined the group on Telegram.

"The video footage shows acts of torture against the macaques (long-tailed macaques/Macaca fascicularis) such as cutting their necks with scissors, burning the macaque while it was still alive and cutting off the animal's fingers one by one in the toilet of his house.

"On the same date (Jan 20), I made a police report at Section 9 Police Station, Shah Alam, Selangor containing detailed information about the individual involved and during the investigation by the police, the man admitted to torturing the monkey children," he said.

However, Dr Kartini claimed that the police had released the individual without any charges being brought against him.

The woman also claimed that on April 5, her lawyer received a letter from the Criminal Investigation Division, Shah Alam District Police Headquarters informing her that the investigation paper for her police report had been referred to the Deputy Public Prosecutor, but it had been classified as no further action (NFA).

"My lawyer has sent a letter to the AGC to get a reason why the police report was classified as NFA, but on May 22, the Prosecution Division of the AGC informed that it is not the practice of the AGC to give reasons for an NFA decision," he said.

He claimed that the AGC's decision to classify his police report as NFA was unreasonable and procedurally wrong because the individual involved had made a confession to the police.

Meanwhile, lawyer Rajesh Nagarajan who represented both applicants when contacted by Bernama confirmed the filing of the application.
