The PH Presidential Council advised Datuk Seri Ismail Sabri Yaakob not to use the advice of the Attorney -General if he did not want to follow in the footsteps of former PM Muhyiddin Yassin.
KUALA LUMPUR: The Attorney-General's statement on the issue of the vote of confidence in Parliament was allegedly contrary to the Yang di-Pertuan Agong's order to all party leaders during the session before His Majesty at the Istana Negara on August 17.
The PH Presidential Council in a statement said, Tan Sri Idrus Harun was a witness and even heard Al-Sultan Abdullah's words during the face-to-face session.
"Istana Negara media statement dated 18 August 2021, His Majesty has said that 'The Prime Minister who has been appointed by His Majesty pursuant to Article 40 (2) (a) and 43 (2) (a) of the Federal Constitution shall as soon as possible submit a motion of confidence in the Dewan Rakyat to legitimize him gaining the trust of the majority of Dewan Rakyat members.
His Majesty's statement was also emphasized by His Majesty the Deputy Yang di-Pertuan Agong and the need for a vote of confidence has been agreed by all party leaders.
"Where is the logic and sanity of the Attorney -General when he says that His Majesty's power to appoint the Prime Minister can be denied by a motion of confidence in Parliament when the tabling of the motion of confidence is ordered by His Majesty himself?" write the statement, on Sunday.
On Saturday, Idrus said there was no need to ratify the appointment of the Prime Minister, Datuk Seri Ismail Sabri Yaakob and the recently formed government.
He said the appointment of the Prime Minister and the formation of the government made earlier was in accordance with the law.
According to him, the thoroughness of the selection process carried out by the Yang di-Pertuan Agong, in electing the Prime Minister shows that the appointment of Ismail Sabri is valid according to the requirements of the Federal Constitution.
Statement with PKR President, Datuk Seri Anwar Ibrahim; Amanah president Mohamad Sabu and DAP secretary-general Lim Guan Eng also stated that the action of a Prime Minister appointed by the Yang di-Pertuan Agong to replace the previous Prime Minister and then submit a motion of confidence in Parliament to legitimize majority support is a precedent action. in the Parliament of Malaysia.
"A vote of confidence took place on January 27, 1976, 12 days after Tun Hussein Onn was appointed Prime Minister to replace the late Tun Abdul Razak, and November 3, 2003, 3 days after Tun Abdullah Ahmad Badawi was appointed Prime Minister to replace Tun Dr Mahathir Mohamad, "The statement is clear.
Therefore, the PH Presidential Council considers that the Attorney General's statement on behalf of the Government is rude, violates the spirit of the Federal Constitution, and even violates the order and also a rebellion against His Majesty.
“Pakatan Harapan is urging the Attorney -General to resign as he has not only rebelled against His Majesty, but he has also betrayed the Federal Constitution and the parliamentary democracy system.
"Pakatan Harapan upholds His Majesty's command that a vote of confidence must be tabled and approved to confirm that the 9th Prime Minister has the confidence of the majority of Dewan Rakyat members at the parliamentary session which begins on September 13," he said.
Thus, the PH Presidential Council advised the Prime Minister, Datuk Seri Ismail Sabri Yaakob not to use the advice of the Attorney General if he did not want to follow in the footsteps of former 8th Prime Minister, Tan Sri Muhyiddin Yassin which resulted in political instability when his legitimacy was doubted and disputed.
