Minister’s brother jailed five years

KOTA KINABALU: The brother of a Federal minister has been jailed five years by the Sessions Court here for causing hurt to a mechanic last year.

Mohd Jusnaidi Omar, 44, also known as Mat Malaya, was found guilty under Section 324 of the Penal Code for causing grievous hurt to mechanic Alkarim Atun, 36, by using a firearm.

He committed the offence at an air-conditioning centre along Jalan Tuaran Bypass at about 5pm on May 6, 2015.

Sessions Court judge Azreena Aziz ruled that Mohd Jusnaidi had failed to cast reasonable doubt in the prosecution’s case during the trial.



She also ordered Mohd Jusnaidi to serve his jail term from the date of his remand last year and denied his application for a stay.

In pressing for a deterrent sentence, Deputy Public Prosecutor Husna Abdul Halim said Mohd Jusnaidi was convicted of a serious offence.

In this case, the weapon involved was a pistol.

The weapon was not easily available and Mohd Jusnaidi, being a former member of the Malaysian military, should have known better than to use the pistol without lawful justification against the victim, Husna added.

The court was also told that Alkarim sustained two gunshots to his right leg and had to undergo surgery.

Counsel Ronny Cham sought a minimum jail sentence for his client whom he said had been released from the main charge under Section 307 of the Penal Code for attempt to murder.

Mat Malaysia is the brother of Selangor Umno chief Tan Sri Mohamed Noh Omar.
