KUALA LUMPUR: Bank Rakyat Malaysia chairman General (Rtd) Tan Sri Abdul Aziz Zainal and its managing director Datuk Mustafha Abd Razak were today charged at the Sessions Court over criminal breach of trust involving almost RM15 million.

Abdul Aziz, 65, claimed trial to abetting Mustafha in the alleged criminal breach of trust of RM14.9 million before Judge Madihah Harullah.

They are accused of committing the offences at Menara Kembar Bank Rakyat, No 33 Jalan Travers on March 11.

Deputy public prosecutor and director of MACC prosecution Masri Mohd Daud requested the court to impose RM2 million in one surety each on both men and also for their passports to be surrendered.

Counsel Tan Sri Muhammad Shafee Abdullah, who is representing Abdul Aziz, said that his client would not be able to raise such an exorbitant amount of bail because he has always been a public servant.

"As a public servant, my client does not have that kind of money and I can also tell you that not a single cent from the RM14 million was found to be in his possession. He will have to spend time in jail if a high bail amount is imposed on him, by the court."

Mustafha's counsel Datuk Kamarulhisham Kamaruddin said bail is imposed for three reasons, to secure court attendance during trial and appeal, no tampering of witnesses and also to ensure the accused doesn't commit further crimes.

"All of my client's bank accounts and that of his wife's at Bank Rakyat, have been frozen by the Malaysian Anti-Corruption Commisson. He will be unable to post bail if the amount is high."

Madihah set bail at RM400,000 witu one surety each, and ordered Abdul Aziz and Mustafha's passports to be surrendered to the court.

The case has been fixed for case management and document submission on Oct 10.
