KUALA PILAH: Fatimah Abdullah, the 51-year-old woman charged with slicing off her husband’s penis in January, was today given a discharge not amounting to an acquittal (DNAA) by the Sessions Court here.

Judge Nariman Badruddin made the ruling after the victim, who is currently in Pakistan, again failed to attend the trial.

Fatimah’s counsel J. Gunamalar had requested for a DNAA when deputy public prosecutor Rahimah Abd Majid sought to continue the trial without Fatimah’s husband, Umar Rahman, 44.

Gunamalar had argued that the prosecution’s case would be baseless with the absence of Umar, the sole witness of the incident.

Fatimah was accused of slicing off her husband’s penis at a house in Batu Kikir, Jempol, at 1.20am on Jan 20.

She was charged under Section 326 of the Penal Code for intentionally causing injury by a dangerous weapon against Umar with a knife.

She pleaded guilty when she was first charged on Jan 28. However, she later changed her plea to “not guilty” on Feb 22.

The court ruled that the prosecution may re-file the case when Umar returns to Malaysia.
