KUALA LUMPUR: A Facebook comment cost a tow truck driver a RM5,000 fine.
Muhammad Annuar Saberi, 30, who was charged under Section 233 of the Communications and Multimedia Act 1998 for posting a comment on Facebook which had given a negative perception towards a police personnel pleaded guilty to the offence at the magistrate's court today.
He was accused of starting the negative comment on his Facebook page 'Joko Sebeleng' asking people to make viral a posting about a traffic sergeant whom he claimed was also an insurance agent. He also urged the Malaysian Anti-Corruption Commission (MACC) to take action on the person.
His comment read:
"Dialah Sarjan.. dialah ejen insurans juga.. Tahniah.. minta SPRM ambil tindakan...kasihanilah kami yang mencari rezeki ditepi jalan ni (IPD Trafic Shah Alam).. minta viralkan".
(This is the sergeant.. who is also an insurance agent. Congratulations.. Malaysian Anti-Corruption Commission (MACC) please take action.. have mercy on us who are making a living by the roadside)
He committed the offence in front of the Shah Alam district police headquarters here at 8.04pm on Dec 29, 2015.
Clad in a pink collared T-shirt, unrepresented Annuar in his mitigation said he has three small children to raise and his income was not fixed.
Deputy public prosecutor Rustam Sanip urged for deterrence saying that the accused's comments had given a negative perception towards the Royal Malaysian Police (PDRM).
"The accused had no previous criminal record and a deterrent sentence must be imposed so that he will not repeat the same offence," he said.
Magistrate Raja Noor Adilah Raja Mahyaldin ordered the accused to serve six months jail if he fails to pay the fine.
