JOHOR BAHRU: Bersatu Information Committee member Badrul Hisham Shaharin better known as Chegu Bard, was charged in the Sessions Court here today with issuing seditious remarks related to the casino project in Forest City, on April 26.

Badrul Hisham, 45, pleaded not guilty after the charge was read before Judge Rasidah Roslee.

He is accused of making seditious remarks on his Facebook account under the name 'Che GuBard' at Mutiara Villa Bukit Bintang, Kuala Lumpur at 6.30 pm, on April 26.

The charge is framed under Section 4(1)(c) of the Sedition Act 1948 (Act 15) which provides a maximum fine of RM5,000 or imprisonment not exceeding three years or both, if found guilty.

Deputy public prosecutors Datuk Masri Mohd Daud, Abdul Ghafar Ab Latif, Abdul Malik Ayob and Nadia Mohd Izhar appeared for the prosecution while Badrul Hisham was represented by Muhammad Rafique Rashid Ali.

Also present was Pasir Gudang Member of Parliament Hassan Abdul Karim to hold a watching brief.

Earlier, Masri offered bail of RM20,000 in one surety in addition to applying for a gag order so that both parties would not issue any comments or public statements on any social media platform until the disposal of the case.

However, Muhammad Rafique requested a lower bail on the grounds that his client supports his wife and four children including one with disabilities and only the client's wife is currently working.

Muhammad Rafique also said that the RM20,000 bail offered by the prosecution is high compared with the RM5,000 penalty provided under the Sedition Act.

"The client has also been accused of the same offence at the Kuala Lumpur Section Court with bail set at RM10,000 in one surety.

"The gag order applied by the prosecution is not specific and is unconstitutional as according to Article 10, Malaysians have the freedom to discuss matters openly according to the law," said the lawyer.

The accused then allowed bail of RM10,000 in one surety and the court rejected the gag order applied by the prosecution.

The court also set June 24 for re-mention.

Yesterday, Badrul Hisham was charged in the Kuala Lumpur Sessions Court with two counts of inciting and issuing defamatory remarks that would tarnish the good name of His Majesty Sultan Ibrahim, King of Malaysia.

He, however, pleaded not guilty after the two charges were read before Judge Siti Aminah Ghazali.

KFC temporarily closes select branches - QSR Brandstton

KUALA LUMPUR: QSR Brands (M) Holdings Bhd and KFC Malaysia have temporarily closed selected branches following the current challenging economic environment.

In one statement, QSR Brands, said the closure was part of its efforts to manage increased business costs and focus on better regional business operations.

"Staff from affected branches were offered the opportunity to move to branches still operating as part of a tactical strategy to optimize resources in business zones that receive higher clientele," it said.

That fact however does not reveal any figures other than QSR Brand's contribution to the economy through job guarantees for 18,000 military personnel in Malaysia, of which approximately 85 percent are Muslim.

"QSR Brands continues to be among the largest tax payers in Malaysia and is proud to be able to give back to the community through KFC Add Hope and the Zakat Wakalah Fund.

"We strongly believe that people will recognize our Malaysian background, our sincerity and our hard work in contributing to the Malaysian ecosystem," said QSR Brands.

A report by the Chinese language daily Nanyang Siang Pau claimed that 108 KFC branches had been temporarily closed, based on Google Maps data.

The report also stated that the branches in Kelantan were most affected so that 21 branches were temporarily closed, while Johor had 15 branches.

Additionally, the Singapore Straits Times also cited an unnamed source from QSR Brands who attributed the closure to a perceived public boycott and it could be seen as an opportunity to wind down several KFC branch operations.

There are more than 600 KFC restaurants in Malaysia, operated by QSR Brands which is now owned by Johor Corporation, a company owned by the Johor state government.

Indonesia sokong pendekatan Malaysia bantu bangun 'peradaban' banduan Indonesia

KUALA LUMPUR: The Sessions Court here today was told that the proposed Jana Wibawa programme was presented to the Cabinet meeting for consideration before the Cabinet decided to give the go-ahead to the programme in 2020.

The Programme for the Empowerment of Competent Bumiputera Contractors (Jana Wibawa) was introduced during the administration of Tan Sri Muhyiddin Yassin to speed up project implementation and to boost the country's economy during the COVID-19 pandemic.

Former Finance Ministry (MOF) Government Procurement Division deputy secretary Rosni Mohd Yusoff, 52, said this during cross-examination by lawyer Amer Hamzah Arshad at the trial of the corruption and money laundering case involving Datuk Wan Saiful Wan Jan.

Amer Hamzah: Do you agree that there was a proposal from the then Finance Minister (Tengku Datuk Seri Zafrul Abdul Aziz) to the former Prime Minister (Muhyiddin) to implement the Jana Wibawa programme and the former Prime Minister mentioned the matter on Aug 3, 2020, regarding his agreement to consider Jana Wibawa programme?

Rosni: Yes, agree.

Amer Hamzah: Following the proposal, the Jana Wibawa programme was then presented to the Cabinet meeting.

Rosni: Agreed.

The third prosecution witness agreed with the lawyer's suggestion that the Cabinet had considered the proposal from the Finance Minister and had confirmed and decided to implement the Jana Wibawa programme on Nov 13, 2020.

Rosni, who is currently working as the Statutory Body Strategy Division secretary, also concurred with the lawyer that the Jana Wibawa could only be implemented after obtaining approval from the Cabinet.

According to her, there are two ways to implement the Jana Wibawa programme, namely via direct negotiations or pre-qualified open tenders.

At the previous proceedings, Rosni said the Prime Minister's Office determined whether the approval of the Jana Wibawa project was through direct negotiations or pre-qualified open tenders.

Wan Saiful, 47, is charged with soliciting bribes from Lian Tan Chuan as an inducement for him to assist Nepturis Sdn Bhd in obtaining the RM232 million Central Spine Road: Sertik to the East Coast Expressway Intersection project,

He was also charged with receiving RM6,962,694.54 in cash via a CIMB Bank Bhd account owned by his company WSA Advisory Group Sdn Bhd from Nepturis' Maybank Islamic Bhd account as a fee for assisting the company in obtaining the project's acceptance letter.

The Tasek Gelugor MP allegedly committed both offences at the Royal Lake Club, Taman Tasik Perdana here in April 2022 and at the CIMB Bank Bhd Bukit Tunku branch between July 8 and Sept 30, 2022.

He is also facing 18 charges of money laundering involving RM5.59 million by transferring and using the illegal proceeds to pay for a Ford Ranger, payments to the National Sports Council, and transferring the money to several company accounts, including one owned by Sinar Karangkraf Sdn Bhd.

The offences were all allegedly committed at the CIMB Bank Bhd Bukit Tunku branch here between Aug 12 and Nov 13, 2022, and the charges were framed under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.

The trial before Judge Rozina Ayob continues tomorrow.

KUCHING: Sarawak Premier Tan Sri Abang Johari Tun Openg agreed with the proposal that investors who are interested in migrating to the state need to deposit at least RM2 million or buy properties worth not less than RM1.5 million.

He said this means that many people see Sarawak as a 'jewel' and that the state's economic performance has surpassed that of Johor.

"We have succeeded in overcoming Johor, we are among the top three states at the moment and may soon overcome Selangor, that's why many people want to move here.

"... we want people who can bring new ideas and good suggestions. If you want to become a permanent resident then you have to invest your money in this state," he told reporters after the World Water Day celebration here today.

Yesterday, Deputy Prime Minister Datuk Seri Fadillah Yusof said one of the conditions to obtain permanent resident status in Malaysia is that the applicant must make an investment in the country.

THE HAGUE: The discovery of mass graves at two Gaza hospitals, said by Palestinian authorities to contain hundreds of bodies, have triggered calls by the U.N. rights chief and others for an international investigation.

While not defined under international law, a mass grave is a burial site containing multiple bodies, the existence of which could be important in detecting possible war crimes.

WHAT IS KNOWN ABOUT MASS GRAVES DISCOVERED IN GAZA?

Palestinian authorities said a grave site discovered at the Nasser hospital, the main medical facility in central Gaza, contained nearly 400 bodies. It was uncovered after Israeli troops pulled out of the city of Khan Younis.

Reuters reporters on Monday saw emergency workers digging corpses out of the ground in the ruins of Nasser hospital.

Another grave site was also found by Palestinian authorities at the Al Shifa hospital in northern Gaza, which had been targeted by an Israeli special forces operation. Reuters has verified footage of the digging of graves near the hospital since November.

United Nations spokesperson Ravina Shamdasani said on Tuesday an investigation was needed to verify the number of bodies, but that "clearly there have been multiple bodies discovered."

"Some of them had their hands tied, which of course indicates serious violations of international human rights law and international humanitarian law, and these need to be subjected to further investigations," Shamdasani said, speaking on behalf of U.N. High Commissioner for Human Rights Volker Turk.

IS THERE AN INVESTIGATION?

The International Criminal Court in The Hague has an active investigation into the atrocities on Oct. 7 by Hamas and the response by the Israeli military.

The office of the prosecutor has jurisdiction in the Palestinian territories, but has not made any public comments about the discovery of mass graves.

WHERE ELSE HAVE MASS GRAVES BEEN DISCOVERED?

Recent examples include the conflicts in Sudan and Ukraine.

Kyiv says more than 1,400 people were killed in the town of Bucha while it was occupied by Russian forces following Moscow's full-scale invasion on Feb. 24, 2022, with more than 175 of the victims discovered in mass graves.

Marking two years since the events in Bucha, Ukrainian Prosecutor General Prosecutor General Andriy Kostin said this month that the killings "bear hallmarks of genocide".

In Sudan's West Darfur, at least 1,000 bodies were buried in Al Ghabat cemetery during weeks of massacres in the city of El Geneina between April and June last year.

IS IT ILLEGAL TO DISTURB A MASS GRAVE?

Under the 1949 Geneva Conventions, to which Israel is a signatory, parties to a conflict must take all possible measures to prevent the dead from "being despoiled".

Customary international humanitarian law (IHL) calls for the dead to be respected, including a duty to prevent despoiling of graves and ensuring the identification and proper burial of human remains.

IHL also prohibits mutilation, desecration and other forms of disrespect towards the dead, while parties should take measures to protect grave sites, including those containing multiple human remains.

In 2002, in a case related to killings of Palestinians in the Jenin refugee camp in the West Bank, Israel's Supreme Court ruled that the Israeli Defence Ministry was responsible under international law "for the location, identification, evacuation, and burial of the bodies" of Palestinians killed in fighting. The judges said bodies should not be buried in mass graves but handed over to the Palestinian authorities.

The International Criminal Court's founding Rome Statute defines the desecration or mutilation of dead bodies as a war crime and this is banned as an outrage upon personal dignity.

Allegations by Palestinian authorities that the Israeli Defence Forces (IDF) had buried the bodies were "baseless and unfounded," the IDF said in a statement. The graves were dug by Palestinians, it said, releasing footage showing the graves pre-dated IDF operations.

IDF forces searching for Israeli hostages had examined bodies buried near Nasser hospital and then returned them, the IDF said. "The examination was carried out respectfully while maintaining the dignity of the deceased," it said.

HAVE MASS GRAVES BEEN IMPORTANT IN PAST WAR CRIMES TRIALS?

Evidence from mass grave exhumations played a crucial role in trials at the U.N. International Criminal Tribunal for the former Yugoslavia (ICTY) that established the 1995 Srebrenica massacre of some 8,000 Muslim men and boys by Bosnian Serb forces was a genocide.

In the trial of Bosnian Serb general Radislav Krstic, the first person to be convicted on genocide charges by the Yugoslav tribunal in 2001, judges found that evidence from exhumations showing hundreds of victims were buried with blindfolds and had their hands likely tied behind their backs was enough to conclude they had not been killed in combat.

"Mass graves contain critical evidence for establishing the truth about events that have taken place," the International Commission on Missing Persons said in a statement about Gaza on Wednesday. "Immediate measures must be taken to protect and document locations where mass graves have been reported in Gaza."

The Hague-based ICMP, which helped identify thousands of victims buried in mass graves during in the Balkan wars in the 1990s, said that in the event that war crimes occurred "these processes make it possible to bring perpetrators to justice".

WHAT ARE THE CONSEQUENCES OF VIOLATING LAWS ON MASS GRAVE?

If the reburial or opening of mass graves led to desecration of human remains, charges could be brought by the ICC. Reports of attempting to cover up crimes by putting people in mass graves could also be used in court as evidence to support that the perpetrators knew the killings were unlawful.

Confirmed cases of people being killed while they had their hands tied behind their backs could be used by judges to conclude that those killed were not active combatants. Under the ICC statute it is a war crime to kill or wound a combatant in custody.

Five policemen facing internal action for allegedly involved in robbing foreign national

BERNAMA

26-04- 2024 12:45 PM

KUALA LUMPUR: Five policemen, who are among seven individuals detained on suspicion of involvement in a robbery of a foreign national involving a sum of RM260,000, are facing internal disciplinary action including possible transfer.

Kuala Lumpur Police Chief, Datuk Rusdi Mohd Isa, said the action would be taken based on the findings of the investigation conducted and the decision by the deputy public prosecutor (DPP).

“These policemen are still in service but are currently inactive. We await the decision of the DPP,” he said after attending the monthly assembly of the Kuala Lumpur Police at the Kuala Lumpur Police Contingent Headquarters today.

Rusdi said that some of the suspects detained would be requested to play a role as witnesses to the case and assist in tracking down another suspect who is still at large.

On April 7, seven individuals, including five policemen, were apprehended on suspicion of robbing a foreign man at a residence in Jalan Tun Razak, resulting in a loss of RM260,000.

On another development, Rusdi said that the Kuala Lumpur Narcotics Crime Investigation Department (NCID) has seized various types of drugs between January and March this year, amounting to RM10.1 million, compared to RM39.7 million in the corresponding period last year.

“During the same period this year, 5,977 individuals were arrested, which is a significant increase from 3,576 individuals arrested in the same period last year,” he said.

Furthermore, Rusdi said online fraud and scam cases, which had been rampant globally, have also contributed to the increase in crime rates in Kuala Lumpur.

He said the Kuala Lumpur Commercial Crime Investigation Department (CCID) had conducted a total of 996 raids for the period from January to March 2024.

“For Call Centre Crimes, CCID has successfully initiated 16 investigation papers involving the arrest of 180 individuals,” he said.

Rusdi added that the Kuala Lumpur Special Branch had been investigating syndicates smuggling untaxed cigarettes and arrested two foreign nationals and confiscated untaxed cigarettes estimated to be worth RM66,205.92 during the same period.
