High Court increases Jail Term of a Molester of a 12 year old boy from 1 day given by a Magistrate to 15 months.

Molester’s jail term extended

 
IPOH: A former school canteen helper who outraged the modesty of a 12-year-old boy fell from his chair after the High Court increased his jail sentence to 15 months.
Mohd Yunus Hassan, 53, (pic) was sentenced last year by the Seri Manjung magistrate’s court to one day’s jail and fined RM4,000 for outraging the modesty of the minor.
The sentence, however, was enhanced yesterday by Justice Datuk Che Mohd Ruzima Ghazali following an appeal by the prosecution. The father of six starting crying, and kept pleading innocence, saying he was framed while policemen in court tried to get him back on his chair.

(Allah, I am not guilty, I did not do it, I am framed, What is going to happen to my children)?” he kept saying after the judge meted out the sentence.
None of his family members were present at the court. While photographers were taking pictures of him on his way to the lockup, he was heard mumbling: “Tak habis habis nak memalukan orang (Still want to continue embarrassing people).”
Justice Che Mohd Ruzima ordered Mohd Yunus, from Kampung Muhibah in Ayer Tawar, to serve the jail sentence from yesterday.
He was convicted of outraging the modesty of the boy by hugging and kissing him on his lips on Nov 18, 2014 at the boys toilet of an Ayer Tawar school.
Justice Che Mohd Ruzima, when reading out his judgment, said the sentence meted out by the magistrate’s court was not sufficient, because outraging the modesty of a minor was unnatural.
“You failed to control your lust, and outraged the modesty of a 12-year-old boy, and the act of yours cannot be forgiven.
“You should have known the consequences of your act, and thought first before doing what you did.
“Since this is a public interest case, I am enhancing the jail term, while the fine amount remains,” he said.
DPP How May Ling earlier asked the court to impose the maximum jail sentence of five years.
She said the original one-day jail term was too light as the magistrate failed to take into consideration the mental and emotional state of the victim after the incident.
How said in the facts of the case, it was related how the accused had followed the boy into the toilet.
“He hugged and kissed him on his lips by biting and sucking them, until the lips were bruised.
“He also warned the victim not to tell anybody about what had happened.
“When the victim’s mother found her son outside the toilet in such a state, she started to cry.
“The accused himself has children aged between seven and 20, and one is the same age as the victim,” she said, adding that the victim was traumatised by the incident.
