Woman Gets Six Months Jail For Slapping Teacher

  • NIBONG TEBAL: A Jawi magistrates' court today sentenced a mother to six months jail and fined RM2,000 after she was found guilty of slapping a teacher from a vernacular school.

Magistrate Shamshol Azwa Martadza passed the sentence on the accused Tan Seow Yen, 35, after the defence failed to raise a reasonable doubt against the prosecution's case.
Tan was found guilty under Section 323 of the Penal Code for slapping L. Vanitha, who is a former Bahasa Malaysia teacher in a vernacular school in Sungai Bakap at 5.15pm on Feb 2, 2015.
The offence of voluntarily causing hurt under the Penal Code carries a maximum one-year jail sentence or a RM2,000 fine or both upon conviction.
Deputy Public Prosecutor (DPP) Afiq Nazrin Zaharinan prosecuted the case while Tan was represented by Mohd Ismail Mohamed.
Vanitha meanwhile, was accompanied by her father, V. Loganathan, 83, and mother S. Mageswari, 66.
Earlier in the court, Mohd Ismail said Tan wanted to meet Vanitha for allegedly hurting her 10-year-old son.
"This is a 'mother's instinct' to protect her child who was pinched by the teacher due to him being weak in Bahasa Malaysia," he told the Magistrate.
Mohd Ismail requested that the court fine her and not sentence her to jail as she had to take care of her three children, aged between eight and 14-years.
Afiq Nazrin, however, sought a deterrant sentence as slapping a teacher was not right.
Outside the court, Vanitha who was in tears said justice was served.
