14 charged with assault, kidnap and murderTHE STAR
BATU PAHAT: Fourteen men were charged in a magistrate’s court here with bashing, kidnapping and murdering a teenager who allegedly refused to marry one of the suspect’s daughter.
For the first charge, Sek Jamaludin Mahmad@Mohamad, 43, M. Seri Viremurugan, 35, Abdul Rafiq Ganasan Abdullah, 49, M. Nagarajan, 29, Mohamad Fairuz Tuah, 28, Mohd Solahhudin Salehin, 32, Hussin Mahmud@Mohamad, 45, Hassan Mahmad, 45, Mohd Abid Ibrahim, 29, W. Shanmugan, 30, Abdul Hadi Abdul Karim, 27, and B. Jaswant Singh 39, are accused of bashing up Mohamad Rauf Othman.
They allegedly committed the offence at Jalan Kundang 11, Taman Bukit Pasir here at about 9.30pm on May 31, 2012.
Sek Jamaludin, Mohamad Fairuz, Mohd Solahhudin, Hassan, Mohd Abid, Shanmugan and Abdul Hadi, who pleaded guilty, were sentenced to 12 days’ imprisonment and a fine of RM1,000 each by magistrate Mohd Zulhilmi Ibrahim.
However, Seri Viremurugan, Abdul Rafiq, Nagaran, Hussin and Jaswant claimed trial to the charge which carries a maximum two-year jail term, a fine or both.
For the second charge, Mohd Solahhudin, Mohamad Fairuz, Mohd Abid, Nagarajan along with two others – Muhammad Thariq Gopal Subramaniam, 34, and Muhamad Arshad Ibrahim, 29 – allegedly kidnapped the victim at Lorong 2, Kampung Baru Sri Gading at about 10pm on the same day.
All six accused pleaded not guilty. The offence carries a jail sentence of up to seven years and a fine.
For the third charge, Sek Jamaludin, Seri Viremurugan, Abdul Rafiq, Nagaran and Mohamad Fairuz were accused of intentionally killing Mohamad Rauf at Jalan Kundang 11, Taman Bukit Pasir at about 11.30pm on the same day.
No plea was recorded for this charge, which carries the mandatory death sentence upon conviction.
The three cases will be mentioned again on Dec 19.
